[F1 Special development orders E+W+S

64.— (1) A special development order made after the commencement of these Regulations may not grant planning permission for development which–

(a) is likely to have a significant effect on a European site in Great Britain (either alone or in combination with other plans or projects), and

(b) is not directly connected with or necessary to the management of the site;

and any such order made before the commencement of these Regulations shall, on and after that date, cease to have effect to grant such permission, whether or not the development authorised by the permission has been begun.

(2) Nothing in [F2 paragraph (1)] shall affect anything done before the commencement of these Regulations.

[F3 (3) A special development order made on or after 21st August 2007 may not grant planning permission for development which is likely to have a significant effect on a European offshore marine site (either alone or in combination with other plans or projects).]]
