The Education (National Curriculum) (Foundation Subjects at Key Stage 4) Order 1994

Having made such arrangements for consultation on their proposals, pursuant tosection 242(1) of the Education Act 1993(1), as they considered appropriate, the Secretary of State for Education, as respects England, and the Seretary of State for Wales, as respects Wales, in exercise of the powers conferred by section 3(4)(a) of the Education ReformAct 1988(2)hereby make the following Order in terms of the draft which has been laid before Parliament and has been approved by resolutions of each House of Parliament:

1.  This Order may be cited as the Education (National Curriculum) (Foundation Subjects at Key Stage 4) Order 1994 and shall come into force on 1st August 1994.

2.—(1) Section 3 of the Education Reform Act 1988(3)

is amended as follows.

(2) In subsection (2)

for “subsection (4)” substitute “subsections (2A), (2B) and (4)”.

(3) In subsection (2)(a), omit “istory, geography”.

(4) In subsection (2)(aa), after “stages” insert “history, geography”.

(5) After subsection (2) insert—

(2A) In relation to schools in England—

(a)a modern foreign language is not a foundation subject in relation to the fourth key stage before—

(i)1st August 1996, in the case of pupils entering the first year of the key stage in 1996; and

(ii)1st August 1997 in the case of all other pupils.

(b)technology is a foundation subject in relation to pupils who entered the first year of the fourth key stage in 1993 but is otherwise not a foundation subject in relation to the fourth key stage before—

(i)1st August 1996 in the case of pupils entering the first year of the key stage in 1996; and

(ii)1st August 1997, in the case of all other pupils.

(2B) In relation to schools in Wales—

(a)a modern foreign language is not a foundation subject in relation to the fourth key stage;

(b)technology is a foundation subject in relation to pupils who entered the first year of the fourth key stage in 1993 but is otherwise not a foundation subject in relation to the fourth key sage.

Explanatory Note

(This note is not part of the Order)

This Order amends section 3 of the Education Reform Act 1988 so as to provide that history and geography are foundation subjects only in relation to the first, second and third key stages and not in relation to the fourth key stage.

This Order further amends section 3, in relation to England, by providing that technology and a modern foreign language cease to be foundation subjects in relation to the fourth key stage until 1st August 1996, in the case of pupils entering the first year of that key stage in 1996, and until 1st August 1997, in the case of other pupils. Technology remains a foundation subject in respect of pupils who entered the first year of the fourth key stage in 1993.

Different provision is made for technology (except in respect of pupils who entered the fourth key stage in 1993) and a modern foreign language in relation to schools in Wales. Section 3 is amended so that technology and a modern foreign language are no longer foundation subjects in relation to the fourth key stage.
