eId="article-1"><heading>Title and commencement</heading><num>1.</num><content><p>This Order may be cited as the European Parliament (Pay and Pensions) Act 1979 (Section 3 (Amendment) Order 1994 and shall come into force on 15th July 1994.</p></content></article><article eId="article-2"><heading>Resettlement grants to persons ceasing to be Representatives</heading><num>2.</num><content><p><mod>For section 3 of the European Parliament (Pay and Pensions) Act 1979<authorialNote class="footnote" eId="f00002" marker="2"><p>Section 3 was substituted by the Parliamentary Pensions <abbr title="et cetera" xml:lang="la">etc.</abbr> Act <ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/1984/52">1984 (c. 52)</ref>, section 14.</p></authorialNote>there shall be substituted the following section:—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><section><num>3.</num><heading>Resettlement grants to persons ceasing to be Representatives.</heading><subsection><num>(1)</num><intro><p>Where a person who is a Representative immediately before the end of any five-year period either—</p></intro><level class="para1"><num>(a)</num><content><p>did not stand for election to the European Parliament at the general election of representatives to the European Parliament held in that period; or</p></content></level><level class="para1"><num>(b)</num><content><p>did so stand (whether for the same or a different constituency) at that election and was not elected,</p></content></level><wrapUp><p>he shall be entitled to a resettlement grant calculated in accordance with the following provisions of this section.</p></wrapUp></subsection><subsection><num>(2)</num><content><p>Where a person becomes entitled to a grant under this section at the end of any five year period, its amount shall be equal to the relevant percentage of a years salary under section 1 at the rate applicable to him immediately before the end of that period, the relevant percentage for this purpose being that shown in the following Table in relation to his age at the end of that period and the number of years for which he has served as a Representative before the end of that period.</p><tblock class="table" of subsection (2)</p><p>the number of years for which a person has served as a Representative before the end of the period in question, there shall be disregarded—</p></intro><level under this section on any previous occasion, any period of service which for those purposes was on that occasion either taken into account or disregarded under paragraph (a).</p></content></level></subsection><subsection><num>(4)</num><content><p>In this section “five-year period” means a period of five years for which Representatives have been elected to the European Parliament; but if any such period is extended or curtailed, the references in this section to the end of that period shall be construed
