CHANGES IN LOCAL GOVERNMENT AREAS

The Hereford and Worcester, Staffordshire and West Midlands (County and Metropolitan Borough Boundaries) Order 1993

The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 1972(1) and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect, with modifications, to proposals submitted to him under sections 47, 48(1) and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:

Citation and commencement

1.—(1) This Order may be cited as the Hereford and Worcester, Staffordshire and West Midlands (County and Metropolitan Borough Boundaries) Order 1993.

(2) This Order shall come into force on 1st December 1993 for any purpose set out in regulation 4(1) of the Local Government Area Changes Regulations 1976(2).

(3) For all other purposes, this Order shall come into force on 1st April 1994.

Interpretation

2.  In this Order—

  • “district” includes a metropolitan borough and a city;

  • “electoral division” means an electoral division of the county to which an area is transferred by this Order(3);

  • “Hereford and Worcester” means the county of Hereford and Worcester, and any reference to Bromsgrove is a reference to the district of that name in that county;

  • “the map” means one or more of the 33 maps prepared by the Department of the Environment, marked “Maps of the Hereford and Worcester, Staffordshire and West Midlands (County and Metropolitan Borough Boundaries) Order 1993”, duly numbered for reference, and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976;

  • “Staffordshire” means the county of Staffordshire, except in the expression “South Staffordshire”, where it means the Staffordshire district of that name, and any reference to Lichfield is a reference to the Staffordshire district of Lichfield;

any reference to an area as unparished is a reference to that area not forming part of any parish;

“ward” means a ward of the district from or to which an area is transferred(4), except in the expression “parish ward”, where it means a ward of the parish to which an area is transferred; and

“West Midlands” means the metropolitan county of West Midlands, any reference to Birmingham, to Dudley, to Walsall or to Wolverhampton is a reference to the West Midlands district of that name, and any reference to Sandwell is a reference to the West Midlands district of that name (except in column 3 of the Table in article 5(1) and column 4 of the Table in article 5(2), where it refers to the Birmingham ward of that name).

Transfers between Hereford and Worcester (Bromsgrove) and West Midlands (Dudley)

3.—(1) The areas which are marked A on map 12 and A on map 13 shall be transferred from Hereford and Worcester, from Bromsgrove, and from the parish of Hagley to—

(a)West Midlands;

(b)Dudley;

(c)the Stourbridge petty sessional division, and the Dudley coroner’s district—

and shall become unparished. The area marked A on map 12 shall additionally be transferred to the Lye and Wollescote ward, and that marked A on map 13 to the Pedmore and Stourbridge East ward.

(2) The unparished areas which are marked B and C on map 12 shall be transferred from West Midlands, from Dudley, and from the ward of Lye and Wollescote and the ward of Pedmore and Stourbridge East respectively to—

(a)Hereford and Worcester;

(b)Bromsgrove;

(c)the parish of Hagley;

(d)the Hagley ward, and the Hagley and Furlongs electoral division; and to

(e)the Bromsgrove and Redditch petty sessional division, and the North Eastern Hereford and Worcester coroner’s district.

Transfers between Staffordshire and West Midlands

4.—(1) Each area which is marked as shown in column 1 of the following Table on the map indicated in column 2 and shall be transferred from Staffordshire, from South Staffordshire, and from the parish named in column 3 to—

(a)West Midlands; and to

(b)the district, ward, petty sessional division and coroner’s district mentioned in column 4—

and shall become unparished.

7.—(1) The area which is marked A on map 7 shall be transferred from Sandwell, and from the Great Barr ward to Walsall, to the Paddock ward, and to the Walsall petty sessional division and the Walsall coroner’s district.

(2) The area which is marked B on map 6 shall be transferred from Sandwell, and from the Wednesbury North ward to Walsall, to the Darlaston South ward, and to the Walsall petty sessional division and the Walsall coroner’s district.

(3) The areas which are marked A and C on map 6 shall be transferred from Walsall, and from the Darlaston South ward to Sandwell, to the Wednesbury North ward, and to the West Bromwich petty sessional division and the Sandwell North coroner’s district.

(4) The area which is marked A on map 8 shall be transferred from Walsall, and from the Pheasey ward to Sandwell, to the Great Barr ward, and to the West Bromwich petty sessional division and the Sandwell North coroner’s district.

Transfers within West Midlands between Dudley and Wolverhampton

8.—(1) The areas which are marked B on map 19 and A on map 20 shall be transferred from Dudley, and from the Coseley East ward to Wolverhampton, to the Wolverhampton petty sessional division and to the Wolverhampton coroner’s district. The areas marked B on map 19 shall additionally be transferred to the Spring Vale ward, and that marked A on map 20 to the Ettingshall ward.

(2) The area which is marked D on map 19 shall be transferred from Wolverhampton, and from the Ettingshall ward to Dudley, to the Coseley East ward, and to the Dudley petty sessional division and the Dudley coroner’s district.

(3) The areas which are marked A and C on map 19 shall be transferred from Wolverhampton, and from the Spring Vale ward to Dudley, to the Coseley East ward, and to the Dudley petty sessional division and the Dudley coroner’s district.

Transfers within West Midlands between Walsall and Wolverhampton

9.—(1) Each area which is marked as shown on the following Table on the map indicated in column 2 shall be transferred from Walsall, and from the ward named in column 3 to Wolverhampton, to the ward named in column 4, and to the Wolverhampton petty sessional division and the Wolverhampton coroner’s district.

Transfer from Wolverhampton to Sandwell

10.  The area which is marked A on map 5 shall be transferred from Wolverhampton, and from the Bilston East ward to Sandwell, to the Princes End ward, and to the West Bromwich petty sessional division and the Sandwell North coroner’s district.

Town and country planning

11.—(1) In this article, “provision” means a provision of a development plan (as defined in section 336(1) of the Town and Country Planning Act 1990(5)).

(2) Any provision applying to an area transferred by this Order shall continue to apply to that area, notwithstanding the transfer, until replaced by a provision which so applies, and which is expressed to supersede the preserved provision.

Application of the Local Government Area Changes Regulations — Bhylls Acre Primary School

12.  Notwithstanding the transfer of area A on map 23 from Staffordshire to West Midlands, and from South Staffordshire to Wolverhampton, regulation 62 (Property, liabilities, contracts, etc., notices and proceedings) of the Local Government Area Changes Regulations 1976 shall not apply to the Bhylls Acre Primary School at Lower Penn, or to any part of its site.

Explanatory Note

(This note is not part of the Order)

This Order makes changes to the boundary—

(a)between the county of Hereford and Worcester (district of Bromsgrove) and the metropolitan county of West Midlands (metropolitan borough of Dudley);

(b)between West Midlands (metropolitan boroughs of Dudley, Walsall and Wolverhampton) and the county of Staffordshire (districts of Lichfield and South Staffordshire); and

(c)within West Midlands, between the following—

(i)the city of Birmingham and the metropolitan borough of Sandwell;

(ii)Dudley and Sandwell;

(iii)Sandwell and Walsall;

(iv)Dudley and Wolverhampton;

(v)Walsall and Wolverhampton; and

(vi)Sandwell and Wolverhampton.

Consequential changes are made to parishes, local government electoral areas, petty sessional divisions and coroners' districts.

The map and table forming part of this Note (Pages 8 to 12) give a general guide to the location, area and population of the land affected. Prints of the detailed order maps (described in article 2) may be inspected at all reasonable times at the offices of the council for each city, district or metropolitan borough affected, and additionally at the offices of the Secretary of State for the Environment located in 2, Marsham Street, London SW1P 3EB.

The Local Government Area Changes Regulations 1976 (S.I. 1976/246, amended by S.I. 1978/247) contain general provisions regarding the effect of orders such as this one.
