The Commissioners for Oaths (Fees) Order 1993

The Lord Chancellor, in exercise of the powers conferred on him by section 81A of the Solicitors Act 19741 and with the concurrence of the Lord Chief Justice and the Master of the Rolls, hereby makes the following Order:

This Order may be cited as the Commissioners for Oaths (Fees) Order 1993 and shall come into force on 18th October 1993.

(2)

In this Order “commissioner for oaths” includes a solicitor exercising the powers of a commissioner for oaths under section 81 of the Solicitors Act 1974 but does not include any person on whom the powers of commissioners for oaths are conferred by virtue only of section 113 of the Courts and Legal Services Act 19902.

The following fees (inclusive of value added tax where payable) shall be charged by commissioners for oaths:–

For taking an affidavit, declaration or affirmation, for each person making the same

5.00

And in addition, for each exhibit therein referred to and required to be marked or for each schedule required to be marked

2.00

The Commissioner for Oaths (Fees)(No. 2) Order 19883 is hereby revoked, save as to any fee due or payable before the coming into force of this Order.

This Order increases the fees chargeable by commissioners for oaths and practising solicitors under section 81A of the Solicitors Act 1974 for taking affidavits and similar declarations from £3.50 to £5.00 and for marking exhibits from £1 to £2. It replaces the Commissioners for Oaths (Fees)(No. 2) Order 1988.
