The Criminal Justice Act 1993 (Commencement No. 1) Order 1993

In exercise of the powers conferred on me by section 78(3) and (4) of the Criminal Justice Act 1993(1), I hereby make the following Order:

1.  This Order may be cited as the Criminal Justice Act 1993 (Commencement No. 1) Order 1993 and extends to England and Wales only.

2.—(1) The provisions of the Criminal Justice Act 1993 referred to in the left-hand column of Schedule 1 to this Order (which relate to the matters described in the right-hand column of that Schedule) shall come into force on 16th August 1993.

(2) The provisions of that Act referred to in the left-hand column of Schedule 2 to this Order (which relate to the matters described in the right-hand column of that Schedule) shall come into force on 20th September 1993.

APPENDIXPROVISIONS OF SCHEDULE 6 COMING INTO FORCE ON 20TH SEPTEMBER 1993

So much of Schedule 6 as relates to the following enactments:—

(being repeals consequential upon the provision made by section 65 and Schedule 3).

Explanatory Note

(This note is not part of the Order)

Article 2(1) of this Order brings into force on 16th August 1993 sections 66 and 67 of the Criminal Justice Act 1993, relating respectively to the powers of the courts to deal with offenders and the penalty for causing death by dangerous driving or by careless driving.

Article 2(2) brings into force on 20th September 1993 section 65 of the Act (fixing of fines) and associated provisions.

By virtue of section 65(4) and section 66(9) the amendments relating to the powers of the courts and the fixing of fines are to apply in relation to offenders convicted (but not sentenced) before the dates on which those sections come into force as they apply in relation to offenders convicted after those dates.
