CHANGES IN LOCAL GOVERNMENT AREAS

The Greater London and Surrey (County and London Borough Boundaries) (No.3) Order 1993

The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 1972(1) and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect, with modifications, to proposals submitted to him under sections 47, 48(1) and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:

Citation and commencement

1.—(1) This Order may be cited as the Greater London and Surrey (County and London Borough Boundaries) (No. 3) Order 1993.

(2) This Order shall come into force on 1st December 1993 for any purpose set out in regulation 4(1) of the Local Government Area Changes Regulations 1976(2).

(3) For all other purposes, this Order shall come into force on 1st April 1994.

Interpretation

2.  In this Order—

“Croydon” means the London borough of Croydon;

“district” includes a borough and a London borough;

“electoral division” means an electoral division of the county of Surrey;

“the map” means one or more of the 12 maps prepared by the Department of the Environment, marked “Maps of the Greater London and Surrey (County and London Borough Boundaries) (No.3) Order 1993”, and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976;

“Surrey” means the county of Surrey, any reference to Epsom is a reference to the Surrey borough of Epsom and Ewell, and any reference to Reigate is a reference to the Surrey borough of Reigate and Banstead;

“Sutton” means the London borough of Sutton; and

“ward” means a ward of the district from or to which an area has been transferred by this Order.

Transfers from Greater London (Sutton) to Surrey (Epsom and Reigate)

3.—(1) The area which is marked C on map 3 shall be transferred from Greater London, from Sutton and from the Cheam South ward to—

(a)Surrey;

(b)Epsom;

(c)the Nonsuch ward and the Epsom and Ewell North East electoral division; and to

(d)the North and East Surrey petty sessional division and the Surrey coroner’s district.

(2) Each area which is marked as shown in column 1 of the following Table on the map indicated in column 2 shall be transferred from Greater London, from Sutton, and from the ward named in column 3 to—

(a)Surrey;

(b)Reigate;

(c)the ward named in column 4;

(d)the Banstead East electoral division; and to

(e)the North and East Surrey petty sessional division and the Surrey coroner’s district.

4.—(1) Each area which is marked as shown in column 1 of the following Table on the map indicated in column 2 shall be transferred from Surrey, from Epsom, and from the ward named in column 3 to—

(a)Greater London;

(c)the ward mentioned in column 4; and to

(d)the Sutton petty sessional area and the Southern London coroner’s district.

5.  The area which is marked R on map 6 shall be transferred from Surrey, from Reigate and from the Chipstead-Hooley and Woodmansterne ward to—

(a)Greater London;

(b)Croydon;

(c)the Woodcote and Coulsdon West ward; and to

(d)the Croydon petty sessional area and the Southern London coroner’s district.

Transfers within Greater London between Croydon and Sutton

6.—(1) Each area which is marked as shown in column 1 of the following Table on the map indicated in column 2 shall be transferred from Croydon, and from the ward named in column 3 to Sutton, to the ward mentioned in column 4, and to the Sutton petty sessional area.

Town and country planning

7.—(1) In this article, “provision” means a provision of a development plan (as defined in section 336(1) of the Town and Country Planning Act 1990(3)).

(2) Any provision applying to an area transferred by this Order shall continue to apply to that area, notwithstanding the transfer, until replaced by a provision which so applies, and which is expressed to supersede the preserved provision.

Explanatory Note

(This note is not part of the Order)

This Order makes mainly small changes in Greater London and the county of Surrey, affecting the boundary of the London borough of Sutton with—

(a)the county of Surrey (boroughs of Epsom and Ewell, and Reigate and Banstead); and with

(b)the London borough of Croydon. It also makes one small change to the boundary between Surrey (borough of Reigate and Banstead) and the London borough of Croydon. Consequential alterations to local government electoral areas, petty sessional divisions and coroners' districts are made. No parishes are affected.

The transfers effected are described in the Table at the end of this Note, which also gives in approximate terms the total area and population of the areas transferred. The Table is a general guide only to the changes, and the maps mentioned in article 2 should be inspected for full details of all transfers. Any person may inspect the maps at any reasonable time at the offices of the council for each borough affected, and additionally at the offices of the Secretary of State for the Environment located in 2, Marsham Street, London SW1P 3EB.

The Local Government Area Changes Regulations 1976 contain general provisions regarding the effect of orders such as this one.

The Greater London and Surrey (County and London Borough Boundaries) Order 1993 (S. I. 1993 No. 1148), which will come into force fully on 1st April 1994, will transfer areas between Greater London and the county of Surrey, affecting the boundaries of the London borough of Croydon with the borough of Reigate and Banstead and with the district of Tandridge. It will also make changes in the boundary between the London boroughs of Bromley and Croydon.

The Greater London and Surrey (County and London Borough Boundaries) (No.2) Order 1993 (S. I. 1993 No. 1208), which also comes fully into force on 1st April 1994, makes a change to the boundary between Surrey (district of Spelthorne) and Greater London (London borough of Richmond upon Thames), and also adjusts the boundary between the London boroughs of Wandsworth and Richmond upon Thames.

Minor realignment of Sutton/Reigate boundary to unite No. 32, carshalton Road in Reigate.

Transfer from Epsom to unite Glebe Road and Villers Road in Sutton.

Transfer from Epsom to Sutton of Cheam Road railway bridge and its southern approach, and part of Cheam Sports Ground.

Realignment of Epsom/Sutton boundary to rear curtilages of properties in Wickham Avenue.
