<Text>The Secretary of State, in exercise of the powers conferred on her by sections 15(1), (2), (3)(a), (5)(a) and (9) and 80(1), (2)(a) and (4) of, and paragraphs 1(1)(a) and (c) and 8 of Schedule 3 to, the Health and Safety at Work <Abbreviation Expansion="et cetera" xml:lang="la">etc.</Abbreviation> Act 1974<FootnoteRef Ref="f00001"/> (“ the 1974 Act”) and of all other powers enabling her in that behalf and—</Text>

<Text>for the purpose of giving effect without modifications to proposals submitted to her by the Health and Safety Commission under section 11(2)(d) of the 1974 Act after the carrying out by the said Commission of consultations in accordance with section 50(3) of that Act; and</Text>

<Text>it appearing to her that the repeal of section 18(1)(f) of the Children and Young Persons Act 1933<FootnoteRef Ref="f00002"/> and section 28(1)(f) of the Children and Young Persons (Scotland) Act 1937<FootnoteRef Ref="f00003"/> except insofar as those provisions apply to such employment as is permitted under section 1(2) of the Employment of Women, Young Persons, and Children Act 1920<FootnoteRef Ref="f00004"/> is expedient in consequence of the Regulations referred to below after the carrying out by her of consultations in accordance with section 80(4) of the 1974 Act,</Text>

<Title>Citation and commencement</Title>

<Text>These Regulations may be cited as the Manual Handling Operations Regulations 1992 and shall come into force on 1st January 1993.</Text>

<P1group RestrictExtent="E+W+S" RestrictStartDate="2015-10-01"><Title>Interpretation</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/2" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/2" id="regulation-2"><Pnumber><CommentaryRef Ref="key-75c2fd5fe20e0dfea3f7e47c9c02d1a5"/>2</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/2/1" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/2/1" id="regulation-2-1"><Pnumber>1</Pnumber><P2para><Text>In these Regulations, unless the context otherwise requires—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“injury” does not include injury caused by any toxic or corrosive substance which—</Text><OrderedList Type="alpha" Decoration="parens"><ListItem><Para><Text>has leaked or spilled from a load;</Text></Para></ListItem><ListItem><Para><Text>is present on the surface of a load but has not leaked or spilled from it; or</Text></Para></ListItem><ListItem><Para><Text>is a constituent part of a load;</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>and “injured” shall be construed accordingly;</Text></Para></ListItem><ListItem><Para><Text>“load” includes any person and any animal;</Text></Para></ListItem><ListItem><Para><Text>“manual handling operations” means any transporting or supporting of a load (including the lifting, putting down, pushing, pulling, carrying or moving thereof) by hand or by bodily force.</Text></Para></ListItem></UnorderedList></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/2/2" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/2/2" id="regulation-2-2"><Pnumber>2</Pnumber><P2para><Text>Any duty imposed by these Regulations on an employer in respect of his employees shall also be imposed on a  <Substitution ChangeId="key-952d5ba30f1513e0a3552a0d3b455fbe-1691604743526" CommentaryRef="key-952d5ba30f1513e0a3552a0d3b455fbe">relevant self-employed person</Substitution>  in respect of himself.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/2/3" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/2/3" id="regulation-2-3"><Pnumber><Addition ChangeId="key-9ec6873aa001a02765b218eb31b20908-1691604797302" CommentaryRef="key-9ec6873aa001a02765b218eb31b20908">3</Addition></Pnumber><P2para><Text><Addition ChangeId="key-9ec6873aa001a02765b218eb31b20908-1691604797302" CommentaryRef="key-9ec6873aa001a02765b218eb31b20908">For the purposes of paragraph (2) “relevant self-employed person” means a self-employed person who conducts an undertaking of a prescribed description for the purposes of section 3(2) of the Health and Safety at Work </Addition><Addition ChangeId="key-9ec6873aa001a02765b218eb31b20908-1691604797302" CommentaryRef="key-9ec6873aa001a02765b218eb31b20908">etc.</Addition><Addition ChangeId="key-9ec6873aa001a02765b218eb31b20908-1691604797302" CommentaryRef="key-9ec6873aa001a02765b218eb31b20908"> Act 1974.</Addition></Text></P2para></P2></P1para></P1></P1group>
<P1group RestrictExtent="E+W+S" RestrictStartDate="1993-01-01">
<Title>Disapplication of Regulations</Title>

<Pnumber><CommentaryRef Ref="key-1b566759c952b42508dda5e83267842d"/>3</Pnumber>
<P1para>
<Text>These Regulations shall not apply to or in relation to the master or crew of a sea-going ship or to the employer of such persons in respect of the normal ship-board activities of a ship’s crew under the direction of the master.</Text>
</P1para>
</P1>
</P1group>
<P1group RestrictStartDate="2002-09-17" RestrictExtent="E+W+S"><Title>Duties of employers</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/4" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/4" id="regulation-4"><Pnumber><CommentaryRef Ref="key-f91ca581592aac34d15b52ad46648366"/>4</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/4/1" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/4/1" id="regulation-4-1"><Pnumber>1</Pnumber><P2para><Text>Each employer shall—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/4/1/a" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/4/1/a" id="regulation-4-1-a"><Pnumber>a</Pnumber><P3para><Text>so far as is reasonably practicable, avoid the need for his employees to undertake any manual handling operations at work which involve a risk of their being injured; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/4/1/b" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/4/1/b" id="regulation-4-1-b"><Pnumber>b</Pnumber><P3para><Text>where it is not reasonably practicable to avoid the need for his employees to undertake any manual handling operations at work which involve a risk of their being injured—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/4/1/b/i" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/4/1/b/i" id="regulation-4-1-b-i"><Pnumber>i</Pnumber><P4para><Text>make a suitable and sufficient assessment of all such manual handling operations to be undertaken by them, having regard to the factors which are specified in column 1 of Schedule 1 to these Regulations and considering the questions which are specified in the corresponding entry in column 2 of that Schedule,</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/4/1/b/ii" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/4/1/b/ii" id="regulation-4-1-b-ii"><Pnumber>ii</Pnumber><P4para><Text>take appropriate steps to reduce the risk of injury to those employees arising out of their undertaking any such manual handling operations to the lowest level reasonably practicable, and</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/4/1/b/iii" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/4/1/b/iii" id="regulation-4-1-b-iii"><Pnumber>iii</Pnumber><P4para><Text>take appropriate steps to provide any of those employees who are undertaking any such manual handling operations with general indications and, where it is reasonably practicable to do so, precise information on—</Text><P5 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/4/1/b/iii/aa" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/4/1/b/iii/aa" id="regulation-4-1-b-iii-aa"><Pnumber>aa</Pnumber><P5para><Text>the weight of each load, and</Text></P5para></P5><P5 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/4/1/b/iii/bb" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/4/1/b/iii/bb" id="regulation-4-1-b-iii-bb"><Pnumber>bb</Pnumber><P5para><Text>the heaviest side of any load whose centre of gravity is not positioned centrally.</Text></P5para></P5></P4para></P4></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/4/2" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/4/2" id="regulation-4-2"><Pnumber>2</Pnumber><P2para><Text>Any assessment such as is referred to in paragraph (1)(b)(i) of this regulation shall be reviewed by the employer who made it if—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/4/2/a" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/4/2/a" id="regulation-4-2-a"><Pnumber>a</Pnumber><P3para><Text>there is reason to suspect that it is no longer valid; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/4/2/b" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/4/2/b" id="regulation-4-2-b"><Pnumber>b</Pnumber><P3para><Text>there has been a significant change in the manual handling operations to which it relates;</Text></P3para></P3><Text>and where as a result of any such review changes to an assessment are required, the relevant employer shall make them.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/4/3" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/4/3" id="regulation-4-3"><Pnumber><Addition ChangeId="key-8ac9dbd11bd309c48ed93f52f811babc-1691604481124" CommentaryRef="key-8ac9dbd11bd309c48ed93f52f811babc">3</Addition></Pnumber><P2para><Text><Addition ChangeId="key-8ac9dbd11bd309c48ed93f52f811babc-1691604481124" CommentaryRef="key-8ac9dbd11bd309c48ed93f52f811babc">In determining for the purposes of this regulation whether manual handling operations at work involve a risk of injury and in determining the appropriate steps to reduce that risk regard shall be had in particular to—</Addition></Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/4/3/a" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/4/3/a" id="regulation-4-3-a"><Pnumber><Addition ChangeId="key-8ac9dbd11bd309c48ed93f52f811babc-1691604481124" CommentaryRef="key-8ac9dbd11bd309c48ed93f52f811babc">a</Addition></Pnumber><P3para><Text><Addition ChangeId="key-8ac9dbd11bd309c48ed93f52f811babc-1691604481124" CommentaryRef="key-8ac9dbd11bd309c48ed93f52f811babc">the physical suitability of the employee to carry out the operations;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/4/3/b" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/4/3/b" id="regulation-4-3-b"><Pnumber><Addition ChangeId="key-8ac9dbd11bd309c48ed93f52f811babc-1691604481124" CommentaryRef="key-8ac9dbd11bd309c48ed93f52f811babc">b</Addition></Pnumber><P3para><Text><Addition ChangeId="key-8ac9dbd11bd309c48ed93f52f811babc-1691604481124" CommentaryRef="key-8ac9dbd11bd309c48ed93f52f811babc">the clothing, footwear or other personal effects he is wearing;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/4/3/c" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/4/3/c" id="regulation-4-3-c"><Pnumber><Addition ChangeId="key-8ac9dbd11bd309c48ed93f52f811babc-1691604481124" CommentaryRef="key-8ac9dbd11bd309c48ed93f52f811babc">c</Addition></Pnumber><P3para><Text><Addition ChangeId="key-8ac9dbd11bd309c48ed93f52f811babc-1691604481124" CommentaryRef="key-8ac9dbd11bd309c48ed93f52f811babc">his knowledge and training;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/4/3/d" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/4/3/d" id="regulation-4-3-d"><Pnumber><Addition ChangeId="key-8ac9dbd11bd309c48ed93f52f811babc-1691604481124" CommentaryRef="key-8ac9dbd11bd309c48ed93f52f811babc">d</Addition></Pnumber><P3para><Text><Addition ChangeId="key-8ac9dbd11bd309c48ed93f52f811babc-1691604481124" CommentaryRef="key-8ac9dbd11bd309c48ed93f52f811babc">the results of any relevant risk assessment carried out pursuant to regulation 3 of the Management of Health and Safety at Work Regulations 1999;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/4/3/e" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/4/3/e" id="regulation-4-3-e"><Pnumber><Addition ChangeId="key-8ac9dbd11bd309c48ed93f52f811babc-1691604481124" CommentaryRef="key-8ac9dbd11bd309c48ed93f52f811babc">e</Addition></Pnumber><P3para><Text><Addition ChangeId="key-8ac9dbd11bd309c48ed93f52f811babc-1691604481124" CommentaryRef="key-8ac9dbd11bd309c48ed93f52f811babc">whether the employee is within a group of employees identified by that assessment as being especially at risk; and</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1992/2793/regulation/4/3/f" IdURI="http://www.legislation.gov.uk/id/uksi/1992/2793/regulation/4/3/f" id="regulation-4-3-f"><Pnumber><Addition ChangeId="key-8ac9dbd11bd309c48ed93f52f811babc-1691604481124" CommentaryRef="key-8ac9dbd11bd309c48ed93f52f811babc">f</Addition></Pnumber><P3para><Text><Addition ChangeId="key-8ac9dbd11bd309c48ed93f52f811babc-1691604481124" CommentaryRef="key-8ac9dbd11bd309c48ed93f52f811babc">the results of any health surveillance provided pursuant to regulation 6 of the Management of Health and Safety Regulations 1999.</Addition></Text></P3para></P3></P2para></P2></P1para></P1></P1group>

<Title>Duty of employees</Title>

<Text>The Secretary of State for Defence may, in the interests of national security, by a certificate in writing exempt—</Text>

<Text>Subject to the exceptions specified in paragraph 2 below, these Regulations give effect as respects Great Britain to the substantive provisions of Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1990/0269" id="c00010" Class="EuropeanEconomicCommunityDirective" Year="1990" Number="269">90/269/<Acronym Expansion="European Economic Community">EEC</Acronym></Citation> on the minimum health and safety requirements for the manual handling of loads where there is a risk particularly of back injury to workers (<Acronym Expansion="Official Journal">OJ</Acronym> <Abbreviation Expansion="Number">No.</Abbreviation> L 156, 21.6.90, p. 9)</Text>

<Pnumber>2</Pnumber>
<P1para>
<Text>These Regulations do not extend to sea transport (<Emphasis>regulation 3</Emphasis>); nor do they give effect to the first indent of article 6.1 of the Directive referred to in paragraph 1 above.</Text>

<Pnumber>3</Pnumber>
<P1para>
<Text>Regulation 4 requires each employer—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>so far as it is reasonably practicable to do so, to avoid the need for his employees to undertake manual handling operations at work which involve a risk of their being injured; or</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>where it is not reasonably practicable to avoid the need for his employees to undertake any manual handling operations at work which involve a risk of their being injured—</Text>
<P4>
<Pnumber>i</Pnumber>
<P4para>
<Text>to assess all such manual handling operations to be undertaken by them having regard to Schedule 1 to these Regulations,</Text>
</P4para>
</P4>
<P4>
<Pnumber>ii</Pnumber>
<P4para>
<Text>to reduce the risk of injury to those employees arising out of their undertaking any such manual handling operations to the lowest level reasonably practicable, and</Text>
</P4para>
</P4>
<P4>
<Pnumber>iii</Pnumber>
<P4para>
<Text>to provide any of those employees who are undertaking any such manual handling operations with certain information about the loads to be carried by them; and</Text>
</P4para>
</P4>

<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>in the circumstances specified in paragraph (2) of that regulation, to review (and where necessary change) any assessment such as is referred to in sub-paragraph (b)(i) above.</Text>

<Pnumber>4</Pnumber>
<P1para>
<Text>Regulation 2(1) defines, among other expressions, what is meant by “injury”, “injured” and “manual handling operations” and regulation 2(2) provides that where these Regulations impose duties on employers in respect of their employees those duties are also imposed on self-employed persons in respect of themselves.</Text>

<P1>
<Pnumber>5</Pnumber>
<P1para>
<Text>Regulation 5 requires each employee while at work to make full and proper use of systems of work provided for his use by his employer in compliance with that employer’s duty under regulation 4(1)(b)(ii) of these Regulations.</Text>

</P1>
<P1>
<Pnumber>6</Pnumber>
<P1para>
<Text>Regulation 6 enables the Secretary of State for Defence to grant certificates of exemption from these Regulations in the interests of national security.</Text>

</P1>
<P1>
<Pnumber>7</Pnumber>
<P1para>
<Text>Regulation 7 extends the application of these Regulations to and in relation to certain premises and activities outside Great Britain.</Text>
</P1para>
</P1>
<P1>
<Pnumber>8</Pnumber>
<P1para>
<Text>Regulation 8 (together with Schedule 2) repeals a number of enactments and revokes a number of instruments.</Text>
