The Secretary of State for Transport makes this Instrument in exercise of powers conferred by Section 106(3) of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:—

1.  The Sandwell Borough Council (Churchbridge Canal Bridges) Scheme 1991 is hereby confirmed without modifications.

2.  The said Scheme as confirmed (hereinafter referred to as “the Scheme”) is set out in the schedule hereto and copies of the Scheme with its accompanying plans are deposited at the offices of the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY, and at the offices of the Sandwell Borough Council, The Sandwell Council House, Oldbury, Warley, West Midlands.

3.  The Scheme will become operative on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

4.  This Instrument may be cited as the Sandwell Borough Council (Churchbridge Canal Bridges) Scheme 1991 Confirmation Instrument 1992.

THE SCHEDULETHE SANDWELL BOROUGH COUNCIL (CHURCHBRIDGE CANAL BRIDGES) SCHEME 1991

The Borough Council of Sandwell (hereinafter referred to as “the Council”) makes the scheme in exercise of its powers under Section 106(3) of the Highways Act 1980 and of all other enabling powers:—

1.  The Council is authorised to construct the bridges to form the route of the highway the A4034 over the navigable waters of the Birmingham Canal at Churchbridge, Oldbury in the Borough of Sandwell in the position and dimensions which are indicated in the schedule and plans annexed hereto.

2.  The West Bridge will replace the existing bridge over the said canal.

3.  The East Bridge will be constructed adjacent to and to the east of the existing bridge over the said canal.

4.  This scheme may be cited as The Sandwell Borough Council (Churchbridge Canal Bridges) Scheme 1991.
