Any payment to a person under section 1 of the Community Care (Direct Payments) Act 1996 or F4as a direct payment as defined in section 4(2) of the Social Care (Self-directed Support) (Scotland) Act 2013F3or under regulations made under section 57 of the Health and Social Care Act 2001 (direct payments)F2or under regulations made under section 57 of the Health and Social Care Act 2001 (direct payments) in respect of his securing community care services, as defined in section 46 of the National Health Services and Community Care Act 1990.

In relation to Wales, any payment to a person as a direct payment made in accordance with regulations made under sections 50 to 52 of the Social Services and Well-being (Wales) Act 2014 (direct payments) in respect of his securing services under Part 4 of the Social Services and Well-being (Wales) Act 2014.
