The Wildlife and Countryside (Registration to Sell etc. Certain Dead Wild Birds) (Amendment) Regulations 1991

The Secretary of State for the Environment, as respects England, the Secretary of State for Wales, as respects Wales, and the Secretary of State for Scotland, as respects Scotland, in exercise of the powers conferred on them by section 6(2) and (7) of the Wildlife and Countryside Act 1981(1), and of all other powers enabling them in that behalf, hereby make the following Regulations:—

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Wildlife and Countryside (Registration to Sell etc. Certain Dead Wild Birds) (Amendment) Regulations 1991 and shall come into force on 1st April 1991.

(2) In these Regulations “the principal Regulations” means the Wildlife and Countryside (Registration to Sell etc. certain Dead Wild Birds) Regulation 1982(2).

Registration

2.  For regulation 4 of the principal Regulations there shall be substituted—

4.  Any registration effected before 1st April 1991 shall cease to have effect on 1st September 1992, and any registration effected on or after 1st April 1991 shall cease to have effect at the expiration of a period of three years beginning with the day on which the registration is effected.

Obligations of registered persons

3.  Regulation 5 of the principal Regulations shall be amended by substituting the words “Schedule 1” for the words “the Schedule”.

4.  Regulation 6 of the principal Regulations shall be amended by inserting after the word “skin” the words “or, where there is no skin, to the skeleton”.

5.  Regulation 7 of the principal Regulations shall be amended—

(a)by inserting after the word “skin”, where it first occurs, the words “or, where there is no skin, to the skeleton”;

(b)by inserting after the word “skin”, in the second and third places where it occurs, the words “or skeleton”.

6.  The Schedule to these Regulations shall be substituted for Schedule 2 to the principal Regulations.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Wildlife and Countryside (Registration to Sell etc. Certain Dead Wild Birds) Regulations 1982 (S.I. 1982/1219) (“the principal Regulations”).

Regulation 2 of these Regulations provides that a registration under the principal Regualations which was made before 1st April 1991 shall expire on 1st September 1992, and that any registration made on or after 1st April 1991 shall expire at the end of a period of three years from the date on which the registration was made.

Regulations 3 to 5 provide that marks enabling dead wild birds to be identified are to be attached to the skeleton of the bird if it has no skin.

Regulation 6 substitutes a new form for registered persons to use whrn supplying information to the Secreatry of State, in accordance with the principal Regualations, regarding the sale of dead wild birds.
