CHANGES IN LOCAL GOVERNMENT AREAS

The Avon and Gloucestershire (County Boundaries) Order 1991

The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) and (5) of the Local Government Act 1972(1) and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect to proposals submitted to him under sections 47, 48(1) and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:

Citation and commencement

1.—(1) This Order may be cited as the Avon and Gloucestershire (County Boundaries) Order 1991.

(2) This Order shall come into force on 21st February 1991 for any purpose set out in regulation 4(1) (coming into operation of order) of the Local Government Area Changes Regulations 1976(2) and for the purposes of article 9 below.

(3) For all other purposes this Order shall come into force on 1st April 1991.

Interpretation

2.  In this Order “boundary map” means one of the 5 maps prepared by the Department of the Environment, marked “Maps of the Avon and Gloucestershire (County Boundaries) Order 1991”, duly numbered for reference and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976.

Transfers from Avon to Gloucestershire

3.—(1) The part of the county of Avon, the district of Northavon and the parish of Hawkesbury marked D1 on boundary map 1 shall be transferred to—

(a)the county of Gloucestershire and the Wotton-under-Edge electoral division of that county;

(b)the district of Stroud and the Wotton and Kingswood ward of that district;

(c)the South Gloucestershire petty sessional division;

(d)the Gloucester Coroner’s district.

(2) The part of the county of Avon, the district of Northavon and the parish of Charfield marked A1 on boundary map 2 shall be transferred to—

(a)the county of Gloucestershire and the Wotton-under-Edge electoral division of that county;

(b)the district of Stroud and the Wotton and Kingswood ward of that district;

(c)the parish of Kingswood;

(d)the South Gloucester petty sessional division;

(e)the Gloucester Coroner’s district.

(3) The part of the county of Avon, the district of Northavon and the parish of Falfield marked A3 on boundary map 4 shall be transferred to—

(a)the county of Gloucestershire and the Berkeley Vale electoral division of that county;

(b)the district of Stroud, and the Berkeley ward of that district;

(c)the parish of Ham and Stone;

(d)the South Gloucester petty sessional division;

(e)the Gloucester Coroner’s district.

(4) The part of the county of Avon, the district of Northavon and the parish of Charfield marked A5 on boundary map 5 shall be transferred to—

(a)the county of Gloucestershire and the Berkeley Vale electoral division of that county;

(b)the district of Stroud and the Vale ward of that district;

(c)the parish of Alkington;

(d)the South Gloucestershire petty sessional division;

(e)the Gloucester Coroner’s district.

(5) The part of the county of Avon, the district of Northavon and the parish of Falfield marked A6 on boundary map 3 shall be transferred to—

(a)the county of Gloucestershire and the Berkeley Vale electoral division of that county;

(b)the district of Stroud and the Berkeley ward of that district;

(c)the parish of Ham and Stone;

(d)the South Gloucestershire petty sessional division;

(e)the Gloucester Coroner’s district.

Transfers from Gloucestershire to Avon

4.—(1) The part of the county of Gloucestershire, the district of Stroud and the parish of Kingswood marked A2 on boundary map 2 shall be transferred to—

(a)the county of Avon and the Ladden Brook electoral division of that county;

(b)the district of Northavon and the Charfield ward of that district;

(c)the parish of Charfield;

(d)the Avon North petty sessional division;

(e)the Avon Coroner’s district.

(2) The part of the county of Gloucestershire, the district of Stroud and the parish of Alkington marked A4 on boundary map 5 shall be transferred to—

(a)the county of Avon and the Ladden Brook electoral division of that county;

(b)the district of Northavon and the Charfield ward of that district;

(c)the parish of Charfield;

(d)the Avon North petty sessional division;

(e)the Avon Coroner’s district.

Town and country planning

5.  Any provision of a development plan applying to an area transferred by this Order shall continue to apply thereto notwithstanding the transfer; and after such transfer, any such provision shall, so far as it so applies, be for all purposes deemed to be a provision of a corresponding plan of the authority which becomes the appropriate local planning authority for the transferred area as a result of the transfer.

Creation of new parish

6.  In the district of Stroud there shall be created a new parish of Hillesley and Tresham which shall consist of the area marked D1 on boundary map 1.

Parish council for new parish

7.—(1) There shall be a parish council for the new parish.

(2) From 1st April 1991 until the fourth day after the ordinary day of elections in 1991 the parish council shall consist of those persons representing the Hillesley and Tresham ward of the parish of Hawkesbury immediately before 1st April 1991: thereafter it shall consist of 7 parish councillors.

(3) The proper officer of Stroud District Council shall convene the first annual meeting of the new parish council and the first assembly of the parish meeting for the new parish: and if the first assembly of the parish meeting is held before the first annual meeting of the new parish council, the parish meeting may appoint a person to take the chair, who shall have, for the purposes of that occasion only, the powers and authority of a chairman.

Parish of Hawkesbury electoral alterations

8.  From 1st April 1991 until the fourth day after the ordinary day of elections in that year the Hawkesbury parish council shall consist of the persons representing the Hawkesbury ward of that parish immediately before 1st April 1991: thereafter it shall consist of 7 parish councillors.

Expenses of new parish council

9.  For the purposes of article 3 of the Local Government Finance (Miscellaneous Provisions) (England) Order 1991(3) and regulation 4(2) of the Community Charges and Non-Domestic Rating (Miscellaneous Provisions) (England) Regulations 1991(4) the amount specified in relation to the new parish of Hillesley and Tresham is £2,000.

Explanatory Note

(This note is not part of the Order)

This Order transfers areas between the counties of Avon and Gloucestershire. Consequential changes to districts, parishes, local government electoral areas, petty sessional divisions and Coroners' districts are made.

The Order creates a new parish of Hillesley and Tresham in the district of Stroud. A parish council is established for the new parish. The new parish will have approximately an area of 536 hectares, and a population of 465.

The areas transferred will have approximately the area and population shown below—

The map forming part of this note gives a general guide to the areas affected. Prints of the detailed boundary maps (described in article 2) may be inspected at all reasonable times at the offices of the district councils whose areas are affected by this Order, and at the office of the Secretary of State for the Environment, 2 Marsham Street, London SW1P 3EB.

The Local Government Area Changes Regulations 1976 contain general provisions regarding the effect of orders such as this one.
