The Nuclear Material (Offences) Act 1983 (Commencement) Order 1991

Her Majesty, in pursuance of section 8(2) of the Nuclear Material (Offences) Act 1983(1), is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

1.  This Order may be cited as the Nuclear Material (Offences) Act 1983 (Commencement) Order 1991.

2.  The Nuclear Material (Offences) Act 1983 shall come into force on 2nd October 1991, except that for the purposes of any Order in Council under section 7(2) thereof it shall come into force forthwith.

Explanatory Note

(This note is not part of the Order)

This Order brings into force on 2nd October 1991 the Nuclear Material (Offences) Act 1983, which implements the Convention on the Physical Protection of Nuclear Material opened for signature at Vienna and New York on 3rd March 1980 (Cmnd. 8112). (Sections 5 and 7(1) of the 1983 Act were repealed by and re-enacted in the Extradition Act 1989 (c. 33), as was section 5A (originally inserted by paragraph 95 of Schedule 15 to the Criminal Justice Act 1988 (c. 33)); section 6 was amended by section 36(9) of the Extradition Act 1989.)
