The Secretary of State for Trade and Industry, in exercise of the powers conferred on him by sections 9(5) and 18(5) of the Restrictive Trade Practices Act 19761, hereby makes the following Order:—

Citation, commencement and interpretation1

This Order may be cited as the Restrictive Trade Practices (Standards and Arrangements) Order 1990 and shall come into force on 11th April 1990.

In this Order

  • “the 1976 Act” means the Restrictive Trade Practices Act 1976;

  • “arrangements” means, in respect of the production, supply or acquisition of any goods or the application to goods of any process of manufacture, arrangements as to the provision of information or advice to purchasers, consumers or users and, in respect of making available, supplying or obtaining any designated services within the meaning of the 1976 Act, arrangements as to the provision of information or advice to persons to or by whom designated services are supplied or agreed to be supplied;

  • “standards” means, in respect of the production, supply or acquisition of any goods or the application to goods of any process of manufacture, standards of dimension, design, quality or performance and, in respect of making available, supplying or obtaining any designated services within the meaning of the 1976 Act, standards of performance in the provision of the services or standards of dimension, design, quality or performance in respect of goods used in providing them.

The standards specified in Part I of the Schedule to this Order, being standards adopted by Electricity Association Services Limited on 6th April 1990 are hereby approved for the purposes of sections 9(5) and 18(5) of the 1976 Act.

The arrangements specified in Part II of the Schedule to this Order, being arrangements adopted by Electricity Association Services Limited on 6th April 1990, are hereby approved for the purposes of sections 9(5) and 18(5) of the 1976 Act.
