<Title>Citation and commencement</Title>

<Text>These Regulations may be cited as the Local Government Officers (Political Restrictions) Regulations 1990 and shall come into force on 1st May 1990.</Text>

</P1group>
<P1group RestrictExtent="E+W+S" RestrictStartDate="2023-10-02"><Title>Interpretation</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/1990/851/regulation/2" IdURI="http://www.legislation.gov.uk/id/uksi/1990/851/regulation/2" id="regulation-2"><Pnumber><CommentaryRef Ref="key-e033594e1e59765202e8b39d775dbd77"/>2</Pnumber><P1para><Text>In these Regulations—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Abbreviation Expansion="Local Government and Housing Act 1989 c. 42">the Act</Abbreviation>” means the Local Government and Housing Act 1989;</Text></Para></ListItem><ListItem><Para><Text> <Addition ChangeId="key-8c8d554898914712faecfd2a059934db-1719503330031" CommentaryRef="key-8c8d554898914712faecfd2a059934db">“Deputy Mayor for Fire” means a person appointed under section 67(1)(b) of the Greater London Authority Act 1999 as the Deputy Mayor for Fire, or appointed under that section and designated as the Deputy Mayor for Fire;</Addition> </Text></Para></ListItem><ListItem><Para><Text> <Addition ChangeId="key-0a4bd1fa72fdab5021957c4169eb4cfe-1719501271574" CommentaryRef="key-0a4bd1fa72fdab5021957c4169eb4cfe">“Deputy Mayor for Policing and Crime” means a person appointed under section 19(1) of the Police Reform and Social Responsibility Act 2011;</Addition> </Text></Para></ListItem><ListItem><Para><Text> <Addition ChangeId="key-011018774b26b23d243f3cff76710cf4-1719504057614" CommentaryRef="key-011018774b26b23d243f3cff76710cf4">“</Addition><Term><Addition ChangeId="key-011018774b26b23d243f3cff76710cf4-1719504057614" CommentaryRef="key-011018774b26b23d243f3cff76710cf4">local authority</Addition></Term><Addition ChangeId="key-011018774b26b23d243f3cff76710cf4-1719504057614" CommentaryRef="key-011018774b26b23d243f3cff76710cf4">” includes a corporate joint committee established by regulations made under Part 5 of the Local Government and Elections (Wales) Act 2021;</Addition> </Text></Para></ListItem><ListItem><Para><Text>references to the appointee are references to a person holding such a post as is mentioned in regulation 3(1) and references to the holding of an appointment shall be construed accordingly;</Text></Para></ListItem><ListItem><Para><Text>references to a political party do not include references to an organisation whose objects relate solely to matters arising in, or connected with, a state which is not  <Substitution ChangeId="key-8528ef812a1d1256d5bd253cf4776bd3-1719503852048" CommentaryRef="key-8528ef812a1d1256d5bd253cf4776bd3">the United Kingdom</Substitution>; and</Text></Para></ListItem><ListItem><Para><Text>references to speaking to the public include references to the giving of an interview which, to the knowledge of the person giving it, is likely to result in the publication of statements made, or opinions expressed, during the course of the interview.</Text></Para></ListItem></UnorderedList></P1para></P1></P1group>
<P1group RestrictExtent="E+W+S" RestrictStartDate="2018-04-01"><Title>Terms of appointment and conditions of employment</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/1990/851/regulation/3" IdURI="http://www.legislation.gov.uk/id/uksi/1990/851/regulation/3" id="regulation-3"><Pnumber><CommentaryRef Ref="key-41b31e9e07ced9803b35695e113b3831"/>3</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/1990/851/regulation/3/1" IdURI="http://www.legislation.gov.uk/id/uksi/1990/851/regulation/3/1" id="regulation-3-1"><Pnumber>1</Pnumber><P2para><Text>   <Substitution ChangeId="key-1434141abe67fb548841e4d49eb92d34-1719501861176" CommentaryRef="key-1434141abe67fb548841e4d49eb92d34"><Substitution ChangeId="key-3e35945acb3a891cde0854a949c0e06f-1719503436337" CommentaryRef="key-3e35945acb3a891cde0854a949c0e06f">Subject to paragraphs (3), (4) and (5)</Substitution></Substitution><Substitution ChangeId="key-1434141abe67fb548841e4d49eb92d34-1719501861176" CommentaryRef="key-1434141abe67fb548841e4d49eb92d34">, the terms of appointment</Substitution>  and conditions of employment of every person holding a politically restricted post under a local authority (including persons appointed to such posts before the coming into force of these Regulations) shall be deemed to incorporate—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1990/851/regulation/3/1/a" IdURI="http://www.legislation.gov.uk/id/uksi/1990/851/regulation/3/1/a" id="regulation-3-1-a"><Pnumber>a</Pnumber><P3para><Text>in all cases, the terms and conditions set out in Part I of the Schedule hereto;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/1990/851/regulation/3/1/b" IdURI="http://www.legislation.gov.uk/id/uksi/1990/851/regulation/3/1/b" id="regulation-3-1-b"><Pnumber>b</Pnumber><P3para><Text>in the case of persons appointed otherwise than pursuant to section 9 of the Act (political assistants), the further terms and conditions set out in Part II of that Schedule; <Title>Incidental and supplementary provisions</Title>

<Pnumber><CommentaryRef Ref="key-94d8f012be3376b8a4cc77eefc9f37b3"/>4</Pnumber>
<P1para>
<Text>In determining whether a person is in breach of a term or condition set out in Part II of the Schedule hereto, regard shall be had, in particular, to the following matters—</Text>

<Pnumber>a</Pnumber>
<P3para>
<Text>whether the appointee referred to a political party or to persons identified with a political party, or whether anything said by him or the relevant work promotes or opposes a point of view identifiable as the view of one political party and not of another; and</Text>
</P3para>
</P3>

<Pnumber>b</Pnumber>

<Text>where the appointee spoke or the work was published as part of a campaign, the effect which the campaign appears to be designed to achieve.</Text>

as an election agent or sub-agent within the meaning of section 67 or section 68 of the Representation of the People Act 1983<FootnoteRef Ref="f00003"/> for a candidate for election as a member of a <Text>These Regulations impose restrictions on the public political activities of local government officers who are appointed to or employed in posts which are politically restricted posts for the purposes of Part I of the Local Government and Housing Act 1989.</Text>

<Text>The restrictions take the form of terms and conditions that are deemed to be incorporated into those officers' terms of appointment and conditions of employment. The restrictions applicable to all holders of politically restricted posts are set out in Part I of the Schedule to the Regulations. Additional restrictions applicable to officers who are not appointed as political assistants under section 9 of the 1989 Act are set out in Part II of the Schedule. Additional restrictions applicable to political assistants appointed under section 9 are set out in Part III of the Schedule.</Text>
