The Local Government Act 1988 (Defined Activities)(Competition) (Wales) (No. 2) Regulations 1990

These Regulations may be cited as the Local Government Act 1988 (Defined Activities) (Competition) (Wales) (No. 2) Regulations 1990 and shall come into force on 13th December 1990.

Section 6 of the Local Government Act 1988 shall apply to functional work of any description falling within the defined activity mentioned in section 2(2)(c) of the 1988 Act (“other cleaning”) if it is proposed to be carried out in Wales by a local authority mentioned in either of the numbered groups set out in Part I of the Schedule on or after the date specified in column 1 of Part II in relation to the group specified opposite that date in column 2 of Part II of the Schedule.

THE SCHEDULE
PART IGROUPS OF LOCAL AUTHORITIES
GROUP 1.
(i)
The county councils of South Glamorgan and Dyfed, and
(ii)
the district councils of Ceredigion; Cynon Valley; Islwyn; Meirionydd; Neath; Rhuddlan; and Wrexham Maelor.
GROUP 2.
The district councils of Aberconwy; Alyn and Deeside; Montgomeryshire; Preseli Pembrokeshire; Llanelli; Ogwr; Cardiff; Blaenau Gwent and Rhondda.

Regulation 5 of the Local Government Act 1988 (Defined Activities) (Competition) (Wales) Regulations 1988 (S.I. 1988/1468) provides that section 6 of the Local Government Act 1988 (restrictions on carrying out functional work) shall apply where certain authorities propose to carry out certain work after the dates specified in the Schedule to the Regulations.
The effect of these Regulations is to postpone the application of section 6 in respect of “other cleaning” as defined in paragraph 3 of Schedule 1 to the Local Government Act 1988 where the date specified in the Schedule to the 1988 Regulations in relation to the authorities specified in Part I of the Schedule to these Regulations was 1st January 1991 or 1st August 1991 to 1st August 1991 or 1st January 1992 respectively.
