In exercise of the powers conferred on the Secretary of State by section 52(7) of the Education Reform Act 19881 the Secretary of State for Education and Science, as respects England, and the Secretary of State for Wales, as respects Wales, hereby make the following Order:
Citation and interpretation1

This Order may be cited as the Education (Eligibility of Primary Schools for Grant-maintained Status) Order 1990 and shall come into force on 1st November 1990.

In this Order “the Act” means the Education Reform Act 1988.
Eligibility of primary schools for grant-maintained status2
Subject to subsections (8) and (9) of section 52 of the Act, all primary schools which are county or voluntary schools shall be eligible for grant-maintained status.
Consequential repeals3
Section 52(6) of the Act (which provides for primary schools with less than three hundred pupils not to be so eligible) and section 52(7) thereof (which enables the Secretary of State to make this Order) are hereby repealed.
