The Housing Support Grant (Scotland) Variation Order 1990

The Secretary of State, in exercise of the powers conferred on him by sections 191, 192 and 193 of the Housing (Scotland) Act 1987(1), and of all other powers enabling him in that behalf, since it appears to him that after the time when the aggregate amount mentioned in section 191(2)(a) of the said Act was estimated for 1989-90 the eligible expenditure of local authorities for that year has been substantially increased by reason of changes which have taken place in the level of the matters specified in section 191(3)(b) of the said Act, and that inadequate account was taken of those changes when the amount mentioned as aforesaid was estimated, and after such consultation with such associations of local authorities as appear to him to be concerned as is required by the said sections 191, 192 and 193, and with the consent of the Treasury, hereby makes the following Order, a draft of which has been approved by the House of Commons:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Housing Support Grant (Scotland) Variation Order 1990 and shall come into force forthwith.

(2) In this Order “the Order of 1989” means the Housing Support Grant (Scotland) Order 1989(2).

(3) Unless the context otherwise requires, expressions used in this Order shall have the same meaning as in the Order of 1989.

Aggregate grant for 1989-90

2.  For the aggregate amount of housing support grants and the general and hostel portions thereof fixed for the year 1989-90 by articles 2 and 3 of the Order of 1989 (as indicated in parenthesis in the second column of the following table) there shall be substituted the amount and portions set out in the third column thereof:–

Apportionment of aggregate grant for 1989-90

3.—(1) The general portion shall be apportioned among appropriate local authorities in proportion to their estimated net expenditures assessed in the manner provided in the Schedule to the Order of 1989.

(2) The hostel portion shall be apportioned among appropriate local authorities in proportion to their estimated net expenditures for the year 1989-90 on the provision of hostels and lodging houses.

Explanatory Note

(This note is not part of the Order)

This Order increases for the year 1989-90 the aggregate amount of housing support grants and its general and hostel portions payable to certain local authorities in Scotland.
