The Secretary of State for Transport makes this Instrument in exercise of powers conferred by section 106(3) of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:

1.  The Cheshire County Council (Shropshire Union Canal Tunnel, Chester) Scheme 1990 is hereby confirmed without modification.

2.  The said Scheme as confirmed (hereinafter known as “the Scheme”) is set out in the Schedule hereto and copies of the Scheme with its accompanying plans are deposited at the offices of the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY; The North West Network Management Division, Department of Transport, Sunley Tower, Piccadilly Plaza, Manchester M1 4BE; The Cheshire County Council, County Hall, Chester and The Chester City Council, Town Hall, Chester.

3.  The Scheme will become operative on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

4.  This Instrument can be cited as the Cheshire County Council (Shropshire Union Canal Tunnel, Chester) Scheme 1990 Confirmation Instrument 1990.

SCHEDULE TO THE INSTRUMENTTHE CHESHIRE COUNTY COUNCIL (SHROPSHIRE UNION CANAL TUNNEL, CHESTER) SCHEME 1990

Cheshire County Council (hereinafter referred to as “The Council”) make the scheme in exercise of their powers under section 106(3) of the Highways Act 1980 and of all other enabling powers—

1.  The Council are hereby authorised to construct under the navigable waters of the Shropshire Union Canal the tunnel specified in the schedule to this scheme and the drawing number R/62759/07/01 annexed to the scheme as part of the highway they are proposing to construct to continue the Chester Western Bypass from Parkgate Road to Sealand Road in the City of Chester in the County of Cheshire.

2.  This Scheme can be cited as the “Cheshire County Council (Shropshire Union Canal Tunnel, Chester) Scheme 1990”.

THE COMMON SEAL OF CHESHIRE COUNTY COUNCIL was hereto affixed this seventh day of February one thousand nine hundred and ninety in the presence of:—

SCHEDULE TO THE SCHEME

1.  Location.

Blacon in the City of Chester in the County of Cheshire.

2.  Points of commencement and termination.

From a point on the south west embankment of the Shropshire Union Canal and located at a distance of approximately 134 metres north east of the proposed intersection of the new road with Cheyney Road north kerbline, to a point on the opposite bank of the said canal located at a distance of approximately 148 metres north of the proposed intersection of the new road with Cheyney Road north kerbline

3.  Length of tunnel.

132 metres overall. 9 metres wide waterway.

4.  Width of tunnel.

1550 metres clear span.

5.  Depth below bed of canal.

1135 metres below bed level of 9090 M AOD.

6.  Construction.

The tunnel shall be formed by provision of an aqueduct consisting of a reinforced concrete structure and substructure, to carry the canal over the proposed bypass.
