The Secretary of State, in exercise of the powers conferred on him by sections 11(3) and 21(3) of the Local Government, Planning and Land Act 19801, and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and extent1

This Order may be cited as the Local Government (Direct Labour Organisations) (Specified Number of Employed Persons) (Scotland) Order 1990 and shall come into force on 1st October 1990.

This Order extends only to Scotland.

Specified number of employed persons2

For the purposes of sections 11(1) and 21(1) of the Local Government, Planning and Land Act 1980 the number of persons hereby specified is fifteen.

Local authorities and development bodies which did not at any one time in the previous financial year employ more than 30 persons for the carrying out of construction or maintenance work are not subject to Part III of the Local Government, Planning and Land Act 1980. Such local authorities and development bodies were also exempt from the requirement to keep separate accounts for each of the descriptions of construction or maintenance work detailed in section 10(2) of the said Act.

This Order reduces to 15 the maximum number of persons on the basis of whose employment both exemptions are available.
