The Local Government Act 1988 (Defined Activities) (Exemptions) (Scotland) Amendment Order 1990
Citation, commencement and extent1.
This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemptions) (Scotland) Amendment Order 1990, shall come into force on 20th August 1990, and shall apply to Scotland only.
Amendment of Order2.
“(1)
In this Order–
“the Act” means the Local Government Act 1988; and
references to section 2(2) of the Act shall be read as references to that subsection as extended by article 2(1) of the Local Government Act 1988 (Competition in Sports and Leisure Facilities) Order 1989.”3.

The Local Government Act 1988 (Defined Activities) (Exemptions) (Scotland) Order 1988 (S.I. 1988/1415) (“the 1988 Order”) provides that an activity listed in section 2(2) of the Local Government Act 1988 shall not be treated as a defined activity for the purpose of that Act so long as specified conditions are fulfilled.
This Order amends the 1988 Order so as to extend its application to the activity of managing sports and leisure facilities, which activity was added to section 2(2) by the Local Government Act 1988 (Competition in Sports and Leisure Facilities) Order 1989 (S.I. 1989/2488).
