The Lord Chancellor, in exercise of the powers conferred on him by sections 8 and 43 of the Legal Aid Act 19881, hereby makes the following Regulations of which a draft has, in accordance with section 36(3)(b) of that Act, been laid before and approved by resolution of each House of Parliament:—

Citation and commencement1

These regulations may be cited as the Legal Advice and Assistance (Scope) (Amendment) Regulations 1990 and shall come into force on 1st August 1990.

Amendment to the Legal Advice and Assistance (Scope) Regulations 19892

In paragraph 2 of the Schedule to the Legal Advice and Assistance (Scope) Regulations 19892

a

in sub-paragraph (b) after the word “under” there shall be inserted the words “the Matrimonial Proceedings (Magistrates' Courts) Act 19603 or”;

b

after sub-paragraph (g) there shall be inserted the following new sub-paragraph—

h

under section 10A of the Fire Precautions Act 19714,

These Regulations amend the Legal Advice and Assistance (Scope) Regulations 1989 by extending the scope of assistance by way of representation (ABWOR) to proceedings under the Matrimonial Proceedings (Magistrates' Courts) Act 1960 (which, notwithstanding its repeal by the Domestic Proceedings and Magistrates' Courts Act 1978, is preserved in relation to existing orders) and section 10A of the Fire Precautions Act 1971.
