The Secretary of State, in exercise of the powers conferred on him by sections 7 and 12 of the Superannuation Act 19721 and of all other powers enabling him in that behalf, after consultation with such associations of local authorities as appeared to him to be concerned and such representatives of other persons likely to be affected by the Regulations as appeared to him to be appropriate in accordance with section 7(5) of that Act, and not having considered consultation with any individual local authority desirable, hereby makes the following Regulations:

Citation and commencement1

These Regulations may be cited as the Local Government Superannuation (Scotland) Amendment (No. 2) Regulations 1990 and shall come into force on 20th July 1990.

Interpretation2

In these Regulations “the principal Regulations” means the Local Government Superannuation (Scotland) Regulations 19872.

Death Gratuity3

In regulation E11 of the principal Regulations, in paragraph (7), after the formula

there shall be added the words

in the case of a person who ceased to be in reckonable service before 20th July 1990 and

in any other case.

These Regulations amend the Local Government Superannuation (Scotland) Regulations 1987 (S.I.1987/1850) to correct an error in the provisions for calculation of death gratuity. The error was introduced by the Local Government Superannuation (Scotland) Amendment Regulations 1990 (S.I.1990/422) which came into force on 1st April 1990.

The amendment does not affect death gratuities payable in respect of persons who have ceased to serve or died before the amending regulations come into force.
