The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred upon them by section 5 of the Landlord and Tenant Act 19851, and of all other powers enabling them in that behalf, hereby make the following Regulations—

These Regulations may be cited as the Rent Book (Forms of Notice) (Amendment) Regulations 1990 and shall come into force on 12th June 1990.

The forms in the Schedule to the Rent Book (Forms of Notice) Regulations 19822 are amended as follows—

a

in paragraph 11 of the forms in Parts I and III, paragraph 13 of the form in Part II and paragraph 8 of the form in Part IV omit “and rates”;

b

in paragraph 9 of the form in Part I for the words from “Full” to “11” substitute “Details of these rules are given in the Department of the Environment and Welsh Office booklets” Letting rooms in Your Home “and” Notice That You Must Leave “, nos. 22 and 24”;

c

in paragraph 9 of the form in Part II for “” Notice to Quit “, nos. 7 and 11” substitute “” Notice That You Must Leave “, nos. 25 and 22”; and

d

in the form in Part III—

i

in paragraph 9 for the words from “booklet” to “1976 .” substitute “Department of the Environment and Welsh Office booklet” Agricultural Lettings “, no. 23 in the series of housing booklets.”; and

ii

in paragraph 10 for “cottage” substitute “property on 31st March 1990. If your property had no rateable value on that date, the provisional rent can be based, broadly, on the property’s letting value”.

These Regulations amend the forms of notice (prescribed by the Rent Act (Forms of Notice) Regulations 1982) which must be inserted in rent books or other similar documents under section 5 of the Landlord and Tenant Act 1985 where a person has a right to occupy premises as a residence at a rent payable weekly and the value of board is not a substantial part of the rent. The forms relate to restricted contracts and regulated tenancies under the Rent Act 1977 (c. 42), statutory tenancies under the Rent (Agriculture) Act 1976 (c. 80) and assured tenancies and agricultural occupancies under the Housing Act 1988 (c. 50). The amendments update references to relevant booklets and relate to the abolition of domestic rating.
