The Secretary of State, in exercise of the powers conferred upon him by section 123(1), (2) and (3) of and paragraph 14 of Schedule 4 to the Patents Act 19771, after consultation with the Council on Tribunals pursuant to section 10(1) of the Tribunals and Inquiries Act 19712 and with the consent of the Treasury pursuant to subsection (4) of the said section 123, hereby makes the following Rules:

These Rules may be cited as the Patents (Fees) Rules 1989 and shall come into force as respects rules 1(1), 2 and 4 on 16th June 1989 and as respects rules 1(2) and 3 on 3rd July 1989.

(2)

The Patents (Fees) Rules 19883 are hereby revoked.

These Rules shall be construed as one with the Patents Rules 19824 and, to the extent that they continue to apply in relation to existing patents and existing applications, the Patents Rules 19685.

The fees to be paid in respect of any matters arising under the Patents Act 19496 or the Patents Act 1977 shall be those specified in the Schedule to these Rules; and in any case where a form specified in the Schedule as the corresponding form in relation to any matter is required by the Patents Rules 1968 or the Patents Rules 1982 to be used, that form shall be accompanied by the fee specified in respect of that matter or, where payment may be made within a prescribed period of time after the form has been filed, the fee so specified shall be paid within that period.

Where application is made on or after 16th June 1989 but before 3rd July 1989 for renewal of a patent in respect of any year beginning on or after 3rd July 1989, the fee payable on such application shall be that which would be payable if the application were made on or after 3rd July 1989 and rules 1(2) and 3 above had come into force.

These Rules revoke and replace the Patents (Fees) Rules 1988. The fees payable under the Patents Act 1977 on forms 6/77, 9/77, 10/77, 11/77, 12/77, 13/77, 14/77, 15/77, 16/77, 17/77, 19/77, 21/77, 26/77, 27/77, 29/77, 30/77, 31/77, 32/77, 33/77, 34/77, 35/77, 36/77,37/77, 38/77, 45/77, 47/77, 48/77, 50/77, 52/77, 53/77, 54/77, 55/77, 56/77 and 57/77 and under the Patents Act 1949 on forms 23, 33, 35, 36, 39, 43, 44, 45, 46, 53, 54, 55, 64, 65 and 68 are increased with effect from 3rd July 1989, except in the case of fees payable for the renewal of a patent in respect of any year beginning on or after 3rd July 1989, which are increased with effect from 16th June 1989. It is estimated that the total amount of fees collected per annum at the new levels will be 5 per cent greater than the amount collected per annum at the existing levels.
