In exercise of the powers conferred upon me by sections 4(5) and (6), 5(1) and 11(1) of the Refuse Disposal (Amenity) Act 1978 (1) and sections 101(4) and (5), 102(2) and 142(1) of the Road Traffic Regulation Act 1984(2) and, in respect of matters prescribed for the purposes of provisions of the Act of 1984, after consultation with representative organisations as required by section 134(2) of that Act, I hereby make the following Regulations:

1.—(1) These Regulations may be cited as the Removal, Storage and Disposal of Vehicles (Prescribed Sums and Charges etc.) Regulations 1989 and shall come into force on 1st June 1989.

(2) The Removal, Storage and Disposal of Vehicles (Charges) Regulations 1985(3) are hereby revoked.

2.—(1) In these Regulations “the Act of 1978” means the Refuse Disposal (Amenity) Act 1978 and “the Act of 1984” means the Road Traffic Regulation Act 1984.

(2) For the purposes of the provisions of regulation 3 below relating to storage, each period of 24 hours therein referred to shall be reckoned from noon on the first day after removal during which the place at which the vehicle is stored is open for the claiming of vehicles before noon.

3.—(1) The prescribed sum for the purposes of section 4(5) of the Act of 1978 and section 101(4) of the Act of 1984 shall be:-

(a)in respect of removal, £75; and

(b)in respect of storage, £10 for each period of 24 hours or a part thereof during which the vehicle is in the custody of the authority.

(2) The prescribed sum for the purposes of section 4(6) of the Act of 1978 and section 101(5) of the Act of 1984 shall be:-

(a)in respect of removal, £75;

(b)in respect of storage, £10 for each period of 24 hours or a part thereof during which the vehicle is in the custody of the authority;

(c)in respect of disposal, £50.

(3) The prescribed charge for the purposes of section 5(1)(a) of the Act of 1978 and section 102(2)(a) of the Act of 1984 shall, in respect of removal, be £75.

(4) The prescribed scale by reference to which charges shall be ascertained in respect of storage for the purposes of section 5(1)(b) of the Act of 1978 and section 102(2)(b) of the Act of 1984 shall be £10 for each period of 24 hours or a part thereof during which the vehicle is in the custody of the chief officer of a police force or the authority as the case may be.

(5) The prescribed manner for determining the charges recoverable in respect of disposal for the purposes of section 5(1)(c) of the Act of 1978 and section 102(2)(c) of the Act of 1984 shall be by reference to a single charge of £50.

Explanatory Note

(This note is not part of the Regulations)

These Regulations prescribe new sums and charges in respect of the removal, storage and disposal of vehicles by the police and local authorities.

The sum or charge in respect of removal from a motorway is increased from £59 to £75. The sum or charge in respect of removal from a place not on a motorway is increased from £57 to £75 in the City of London and Metropolitan Police District and from £55 to £75 elsewhere in Great Britain. The sum or charge in respect of removal from a loading area is increased from £57 to £75 in the City of London and the Metropolitan Police District and from £55 to £75 elsewhere in England and Wales (there being no loading areas in Scotland).

The sum or charge in respect of storage for each period of 24 hours (or a part thereof) is increased from £5 to £10 and the sum or charge in respect of the disposal of a vehicle is increased from £12 to £50.
