The Local Government Reorganisation (Property)(West Yorkshire) Order 1989

Whereas the West Yorkshire Residuary Body, acting pursuant to section 67(2) of the Local Government Act 1985(1), has submitted further proposals to the Secretary of State for the transfer of certain of its properties to local authorities, and he has decided to give effect to those proposals:

Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 67(3) of that Act, and of all other powers enabling him in that behalf, hereby makes the following Order:—

1.  This Order may be cited as the Local Government Reorganisation (Property) (West Yorkshire) Order 1989 and shall come into force on 31st May 1989.

2.  There shall vest in each local authority mentioned in the Schedule to this Order—

(a)all interests of the West Yorkshire Residuary Body in the property so mentioned in relation to that local authority; and

(b)all rights and liabilities of that Body acquired or incurred exclusively in connection with that property.

SCHEDULELAND TRANSFERRED TO LOCAL AUTHORITIES

BRADFORD CITY COUNCIL

  • A.  120 Birch Lane, West Bowling, Bradford

  • 126 Birch Lane, West Bowling, Bradford

  • 45 Dalcross Street, West Bowling, Bradford

  • A parcel of land consisting of approximately 69 square yards between Hillside Terrace and Browgate, Baildon, Shipley.

  • The site of 1 The Walk, Keighley.

CALDERDALE METROPOLITAN BOROUGH COUNCIL

  • B.  A parcel of land consisting of approximately 133 square yards on the south eastern side of Longfield Road, Salford, Todmorden.

  • A parcel of land consisting of approximately 854 square yards at the junction of Granny Hill and Burnley Road, Halifax.

  • A parcel of land consisting of approximately 3,243 square yards on the northern side of Shroggs Road, Halifax.

  • A parcel of land consisting of approximately 400 square yards between Lee Mount Road and Ovenden Road, Lee Mount, Halifax.

KIRKLEES METROPOLITAN BOROUGH COUNCIL

C.  A parcel of land consisting of approximately 127 square yards south of and opposite numbers 73 to 79 Whiteley Street, Huddersfield.

A parcel of land consisting of approximately 400 square yards fronting numbers 132 to 146 Staincliffe Road, Dewsbury.

LEEDS CITY COUNCIL

D.  A parcel of land consisting of approximately 22·476 acres at West Wood Tip, Middleton, Leeds, bounded to the west by the Leeds to London railway line, to the north by West Wood Golf Course, to the east by Bodmin Road and Padstow Gardens and to the south by West Wood Road.

A parcel of land consisting of approximately 25 acres at Churwell, Leeds, bounded to the west by the A653 trunk road, to the south by West Wood Road, to the east by the Leeds to London railway line and to the north by the Mill Shaw Beck reservoir.

WAKEFIELD CITY COUNCIL

E.  A parcel of land consisting of approximately 2,906 square yards to the north of Ellins Terrace, Normanton.

A parcel of land consisting of approximately 23·8 acres bounded by the A61 Leeds Road to the west, Park Drive to the south and a track leading to Lofthouse Park Farm to the east of Lofthouse Park, Lofthouse, Leeds.

Explanatory Note

(This note is not part of the Order)

The Local Government Reorganisation (Property) (West Yorkshire) Orders 1987 and 1988 (S.I. 1987/15, 1451, 1988/751 and 1745) transferred specified property formerly vested in West Yorkshire County Council and in the West Yorkshire Residuary Body to certain of the district councils in that county. This Order makes further transfers of the same kind.

With one exception, article 2 transfers the property described in the Schedule, together with ancillary rights and liabilities, from the Residuary Body to the council of the district in which the property is situated. The exception relates to a parcel of land at Lofthouse Park, Lofthouse, Leeds, which is transferred to Wakefield City council.
