Her Majesty, in exercise of the powers conferred by section 84(3) and (4) of the Health and Safety at Work etc. Act 19741, is pleased to order, by and with the advice of her Privy Council, and it is hereby ordered, as follows:–
Citation and commencement1
This Order may be cited as the Health and Safety at Work etc. Act 1974 (Application outside Great Britain) (Variation) Order 1989 and shall come into force on 22nd May 1989.
Offshore Installations2
For article 4(2) (definition of“offshore installation”) of the Health and Safety at Work etc. Act 1974 (Application outside Great Britain) Order 19772 (“the 1977 Order”) there shall be substituted the following provision–

In this Article–
“offshore installation” means an offshore installation within the meaning of section 1 of the Mineral Workings (Offshore Installations) Act 19713 which is within territorial waters or a designated area.
Pipelines3
In article 5(2) of the 1977 Order (definition of“pipeline”)
a
after sub-paragraph (a) in the definition of“pipeline”, there shall be inserted the following sub-paragraph–
aa
any apparatus for treating or cooling any thing which is to flow through, or through part of, the pipe or system;
b
in sub-paragraph (ii) the words“and is capable of being manned” shall be omitted.
