The Criminal Justice Act 1988 (Commencement No. 6) Order 1989

In exercise of the powers conferred on me by section 171(1) of the Criminal Justice Act 1988(1), I hereby make the following Order:

1.  This Order may be cited as the Criminal Justice Act 1988 (Commencement No. 6) Order 1989.

2.  The following provisions of the Criminal Justice Act 1988 shall come into force on 23rd January 1989:-

(a) section 103 (amendments of the Drug Trafficking Offences Act 1986(2) and Criminal Justice (Scotland) Act 1987(3) to the extent necessary to bring into force the provisions of Schedule 5 (drug trafficking amendments) specified in paragraphs (b) and (c) below; and

(b) paragraphs 2, 3(1), 4 to 11 and 16 & 17 of Schedule 5 (which amend the said Act of 1986 so as to make certain provisions of that Act correspond to provisions of Part VI of the Criminal Justice Act 1988);

(c) Part II of that Schedule (amendments of the Criminal Justice (Scotland) Act 1987);

(d) section 170(2) (repeals) to the extent necessary to bring into force the provisions of Schedule 16 specified in the following paragraph; and

(e) in Schedule 16, the repeals of the following provisions of the Drug Trafficking Offences Act 1986: section 10(1), section 15(5)(b) and (c), in section 17(1), the words from “but” to the end, and in section 38(11), the words “in England and Wales”.

Explanatory Note

(This note is not part of the Order)

This Order brings into force, in part, on 23rd January 1989, section 103 of and Schedules 5 and 16 to, the Criminal Justice Act 1988. The provisions brought into force make amendments to the Drug Trafficking Offences Act 1986 and the Criminal Justice (Scotland) Act 1987 and associated repeals.
