The Lotteries (Gaming Board Fees) Order 1989

In pursuance of sections 18(1)(e) and 24(2) of the Lotteries and Amusements Act 1976(1), I hereby make the following Order:

1.  This Order may be cited as the Lotteries (Gaming Board Fees) Order 1989 and shall come into force on 1st April 1989.

2.  The fee payable to the Board on an application for the registration of a scheme shall be–

(a)where the total value of the tickets or chances which may lawfully be sold in each lottery under the scheme does not exceed £10,000, a fee of £100; and

(b)in any other case, a fee of £350.

3.  The further fee payable to the Board, where more than one lottery is to be promoted under a scheme registered by the Board, for each lottery promoted under that scheme shall be–

(a)where the total value of the tickets or chances sold in the lottery does not exceed £10,000, a fee of £30;

(b)where the total value of the tickets or chances sold in the lottery exceeds £10,000 but does not exceed £20,000, a fee of £60; and

(c)in any other case, a fee of £75.

4.  The Lotteries (Gaming Board Fees) Order 1988(2) is hereby revoked.

Explanatory Note

(This note is not part of the Order)

This Order increases the fees which are payable to the Gaming Board under paragraph 7(1) of Schedule 2 to the Lotteries and Amusements Act 1976 in connection with the registration of lottery schemes and with the lotteries promoted under schemes registered by the Board. The fees are prescribed as fixed sums, in contrast to the maximum levels (below which the Board could determine a lesser fee) previously prescribed by the Lotteries (Gaming Board Fees) Order 1988. Accordingly the maximum fees of £75 and £290 which were payable respectively in cases to which article 2(a) and (b) apply are replaced by the fixed sums of £100 and £350. The maximum fees of £22, £45 and £60 which were payable respectively in cases to which article 3(a), (b) and (c) apply are replaced by the fixed sums of £30, £60, and £75.
