The Queen’s Most Excellent Majesty in Council

Whereas His late Majesty King George the Fifth by a Royal Charter granted on the1st day of March 1920 (hereinafter referred to as “the Charter”) established, by the name of King George’s Fund for Sailors, a body corporate (hereinafter referred to as “the Corporation”) with the object of contributing to the welfare and furtherance of the objects of Marine Benevolent Institutions:

And Whereas His late Majesty King George the Sixth by a Supplemental Charter granted on the 16th day of May 1949 (hereinafter referred to as “the Supplemental Charter”), amongst other things, extended the objects of the Corporation:

And Whereas on the 9th day of October 1989 the Charity Commissioners for England and Wales did, in pursuance of section 18 of the Charities Act 1960(1), make a Scheme relating to the Corporation:

And Whereas part of the said Scheme cannot come into operation unless or until Her Majesty in Council thinks fit to amend the Charter in such manner as will permit such part of the Scheme to have effect:

And Whereas the Corporation has accordingly made application to Her Majesty in Council for the amendment of the Charter:

Now, therefore, Her Majesty, in exercise of the powers conferred on Her by section 15(2) of the Charities Act 1960, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

1.  That the Charter as amended by the Supplemental Charter be further amended as set out in the Schedule to this Order.

2.  This Order may be cited as the King George’s Fund for Sailors (Amendment of Charter) Order 1989.

SCHEDULEAMENDMENTS TO THE CHARTER OF KING GEORGE'S FUND FOR SAILORS

1.  For Article 1(a) substitute:—

(a)To:—

(i)secure more efficient aid and support for Marine Benevolent Institutions established within the Commonwealth supported wholly or in part by public contributions, by endowments or by the income of endowments, or by any combination thereof, and to obtain from public benevolence by means of subscription, donation, bequest or otherwise gifts of money or property;

(ii)make grants to any other organisation established within the Commonwealth subject to the condition that such grants shall be applied by such organisation for charitable purposes for the benefit of sailors as hereinafter defined..

2.  In Article 8 for “British Empire” in each place where these words appear substitute “Commonwealth”.

3.  For Article 20 substitute:—

20.  In these presents—

(a)the words “Marine Benevolent Institutions” or “Institutions” shall mean institutions which materially relieve the need of sailors, or their families and dependants, and institutions for the training of young persons to be sailors and for the training of sailors, and the provision and support of lifeboats, and other institutions for the promotion of safety at sea.

(b)the word “Sailors” shall mean all persons of either sex customarily found on the books of, or forming or who have formed part of the ship’s company of ships or vessels of all kinds of the British Navy or the navy or the marine service or the mercantile marine service or fishing fleets or fishing boats of every and any part of the Commonwealth or any state under the control or protection of the British Government..

This Order amends the Charter of the King George’s Fund for Sailors pursuant to a Scheme made by the Charity Commission on 9th October 1989 under section 18 of the Charities Act 1960.
