The Wirral Metropolitan Borough Council M53 Motorway (Moreton Spur Extension to Upton Bypass) Scheme 1988 Confirmation Instrument 1989

The Secretary of State makes this Instrument in exercise of powers conferred by sections 16 and 17 of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:

1.  The Wirral Metropolitan Borough Council M53 Motorway (Moreton Spur Extension to Upton Bypass) Scheme 1988 is hereby confirmed with modification.

2.  The said scheme as confirmed (hereinafter referred to as “the Scheme”) is set out in the Schedule hereto and copies of the Scheme with its accompanying plan are deposited at the Department of Transport, Sunley Tower, Piccadilly Plaza, Manchester M1 4BE and at the offices of the Wirral Metropolitan Borough Council at the Town Hall Wallasey.

3.  The Scheme will become operative on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

4.  This Instrument may be cited as the Wirral Metropolitan Borough Council M53 Motorway (Moreton Spur Extension to Upton Bypass) Scheme 1988 Confirmation Instrument 1989.

THE SCHEDULETHE WIRRAL METROPOLITAN BOROUGH COUNCIL M53 MOTORWAY (MORETON SPUR EXTENSION TO UPTON BYPASS) SCHEME 1988

The Wirral Metropolitan Borough Council make this scheme in exercise of their powers under sections 16 and 17 of the Highways Act 1980 and of all other enabling powers:—

1.  The Council is authorised to provide for the use of traffic of classes I and II of the classes of traffic set out in Schedule 4 of the Highways Act 1980 a special road along the route described in the Schedule to this scheme.

2.  The centre line of the special road is indicated by a heavy black line on the deposited plan.

3.  In this scheme:—

(1) all measurements of distance are measured along the route of the relevant highway;

(2) (i) “the Council” means the Wirral Metropolitan Borough Council.

(ii)“the special road” means the special road which the Council is authorised by this scheme to provide.

(iii)“the deposited plan” means the plan marked “the Wirral Metropolitan Borough Council, M53 Motorway (Moreton Spur extension to Upton Bypass) Scheme 1988” and numbered MS/35/CR/1. sealed with the Common Seal of the Wirral Metropolitan Borough Council and deposited at the offices of the Council at Wallasey Town Hall. A certified copy is also deposited at the Department of Transport, Sunley Tower, Piccadilly Plaza, Manchester M1 4BE.

4.  This scheme may be cited as “the Wirral Metropolitan Borough Council, M53 Motorway (Moreton Spur extension to Upton Bypass) Scheme 1988”.

THE SCHEDULEROUTE OF THE SPECIAL ROAD

A route, about 400 metres in length connecting the M53 Moreton Spur Motorway, (by means of a roundabout junction), with a proposed all-purpose classified road, known as the Upton Bypass.

The special road commences at the point where the eastbound “on” and westbound “off” slip roads leave the eastbound and westbound carriageways of the M53 Moreton Spur Motorway, 260 metres east of the east face of the Moreton Road bridge, and proceeds in a generally westerly direction for the distance of 400 metres, passing under the Moreton Road bridge to a proposed roundabout junction with the Upton Bypass; a classified road all-purpose highway.

The commencement and termination points of the special road are indicated by the letters “A” and “B” respectively on the deposited plan.
