The Secretary of State, in exercise of the powers conferred on him by section 8(1) and (3) of the Employment Act 1989(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as The Sex Discrimination Act 1975(2) (Exemption of Special Treatment for Lone Parents) Order 1989 and shall come into force on 19th December 1989.

Interpretation

2.  In this Order–

“child of that lone parent” means a person who for the purposes of any regulations made in pursuance of section 20(1)(a) of the Social Security Act 1986(3) is–

(a)a child or young person for whom that lone parent is responsible, and

(b)a member of the same household as that lone parent; and

“Employment Training” means the arrangements known by that name made under section 2 of the Employment and Training Act 1973(4).

Exemption of Special Treatment

3.  With respect to Employment Training, section 8 of the Employment Act 1989 shall apply to any special treatment afforded–

(a)by the making of any payment, in connection with the participation of a lone parent in Employment Training, to a person having the care of a child of that lone parent, or

(b)by the fixing of any special condition for the participation of lone parents in Employment Training.

Explanatory Note

(This note is not part of the Order)

This Order provides with respect to Employment Training that section 8 of the Employment Act 1989 shall apply to any special treatment afforded (a) by the making of any payment, in connection with the participation of a lone parent in Employment Training, to a person having the care of a child of that lone parent or (b) by the fixing of any special condition for the participation of lone parents in Employment Training (Article 3).

“Employment Training” is defined by Article 2 to mean the arrangements known by that name made under section 2 of the Employment and Training Act 1973.

By virtue of section 8(2) of the Employment Act 1989, where the section applies to any special treatment afforded to or in respect of lone parents, neither the treatment so afforded nor any act done in the implementation of such treatment shall be regarded for the purposes of the Sex Discrimination Act 1975 as giving rise to any discrimination falling within section 3 of that Act (discrimination against married persons for the purposes of Part II of that Act).
