The Education (Grants for Training of Teachers and Community Education Workers) (Scotland) Regulations 1989

The Secretary of State, in exercise of the powers conferred on him by sections 73(a), (f) and (g) and 74(1) of the Education (Scotland) Act 1980( (1)), and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Education (Grants for Training of Teachers and Community Education Workers) (Scotland) Regulations 1989 and shall come into force on 31st March 1989.

Interpretation

2.  For the purposes of these Regulations—

(a)any reference to a teacher shall include a teacher employed in providing further education and an educational psychologist;

(b)any reference to a community education worker shall mean any person other than a teacher who works for a local authority whether for payment or otherwise wholly or partly for purposes of education; and

(c)any reference to a local authority shall mean a regional or islands council.

Grants by the Secretary of State to education authorities

3.  The Secretary of State may, subject to and in accordance with the provisions of these Regulations, pay to education authorities grants of such amounts as appear to him appropriate in respect of teachers in their employment undergoing in-service training or attending seminars organised by the Scottish Committee for Staff Development in Education or in respect of the development or preparation of materials for in-service training of teachers.

Grants by the Secretary of State to local authorities

4.  The Secretary of State may, subject to and in accordance with the provisions of these Regulations, pay to local authorities grants of such amounts as appear to him appropriate in respect of the attendance at courses to which these Regulations apply by community education workers.

Training in respect of which grants may be paid

5.  A grant may be paid only in respect of a course within a subject area listed in the Schedule to these Regulations or a seminar organised by the Scottish Committee for Staff Development in Education.

Application for and payment of grants

6.—(1) Applications for grants shall be made in writing to the Secretary of State by an education authority or local authority.

(2) Payment of these grants shall be made to the education authority or local authority in arrear.

Revocation

7.  The Education (Grants for Training of Teachers and Community Education Workers) (Scotland) Regulations 1988( (2)) are hereby revoked.

  • Modular course provision in the secondary school.

  • Adult basic education.

  • General

  • Health education.

  • Management for promoted staff in schools.

  • Courses in retraining in computing, business studies, technological education and modern languages.

Explanatory Note

(This note is not part of the Regulations)

Under section 73 of the Education (Scotland) Act 1980 the Secretary of State may in accordance with regulations made by him make payment of such sums as appear to him appropriate for various purposes. Section 74(1) of the Act enables the Secretary of State to prescribe in regulations conditions and requirements with which the recipients of the grant must comply.

These Regulations revoke and replace the Education (Grants for Training of Teachers and Community Education Workers) (Scotland) Regulations 1988. They continue to provide for the payment to education authorities of grants in respect of teachers undergoing in-service training courses in the subject areas listed in the Schedule to the Regulations which has been brought up to date to take account of available courses and the recommendations made by the Scottish Committee for Staff Development in Education. They also provide for grants to be paid in respect of teachers attending seminars organised by the Scottish Committee for Staff Development in Education. “Teacher” is defined to include educational psychologists.

The Regulations also make provision for the payment of grants to local authorities in respect of the attendance of community education workers at these courses and provide a definition of “community education worker” .
