The Housing (Right to Buy) (Prescribed Persons) Order 1989

Coming into force
The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by section 130(2)(a) and paragraph 8 of Schedule 4 to the Housing Act 19851, and of all other powers enabling them in that behalf, hereby make the following Order:
Citation, commencement and application1

This Order may be cited as the Housing (Right to Buy) (Prescribed Persons) Order 1989.

This Order comes into force on 10th March 1989 and applies in relation to claims made on or after that date to exercise the right to buy, the right to a shared ownership lease or the right to acquire an additional share.

This Order also applies in relation to a claim made before that date to exercise–
a
the right to buy or the right to a shared ownership lease unless before that date–
i
the landlord has duly served a notice denying that claim; or
ii
the transaction has been completed;
b
the right to acquire an additional share, unless the transaction has been completed before that date.
Amendment of 1984 Order2
The Housing (Right to Buy) (Prescribed Persons) Order 19842 is amended as follows:
a
by the deletion of article 3(2)(a);
b
by the substitution of“The British Coal Corporation” for“The National Coal Board” in the Schedule.
Prescribed Persons3
The following persons and any predecessor of any of those persons are prescribed in all circumstances for the purposes of section 130(2)(a) and paragraph 8 of Schedule 4 to the Housing Act 1985:
a
The AFRC Institute for Grassland and Animal Production,
b
The Church Commissioners,
c
The Historic Buildings and Monuments Commission for England,
d
The Lee Valley Regional Park Authority,
e
The Sports Council for Northern Ireland.
