Coming into force

The Secretary of State for Social Security, in exercise of powers conferred by section 28(10) of the Social Security Act 19861 and section 166(1) to (3A) of the Social Security Act 19752 and of all other powers enabling him in that behalf, after consultation with organisations appearing to him to be representative of the authorities concerned3, hereby makes the following Order:

Citation and commencement

This Order may be cited as the Housing Benefit (Permitted Totals) Amendment Order 1989 and shall come into force on 9th October 1989.Amendment of the Housing Benefit (Permitted Totals) Order 1988

The Housing Benefit (Permitted Totals) Order 19884 shall be amended—

a

in article 1(2) (interpretation) by inserting after “rate rebate” the words “(or, in Scotland, community charge rebate)”5; and

b

in article 2 (permitted totals of benefit) by substituting for “(additional amount of benefit in exceptional circumstances)” the words “and regulation 57 of the Housing Benefit (Community Charge Rebates) (Scotland) Regulations 19886 (increase of benefit paid in exceptional circumstances)”.

This Order amends the Housing Benefit (Permitted Totals) Order 1988 to take account of the replacement of rate rebates by community charge rebates in Scotland.
