The Motor Vehicles (Type Approval) (Amendment) Regulations 1989

The Secretary of State for Transport, being a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the regulation of the type, description, construction or equipment of vehicles, and of components of vehicles, and in particular any vehicle type approval scheme, in exercise of the powers conferred by that section and of all other enabling powers, hereby makes the following Regulations:—

1.  These Regulations may be cited as the Motor Vehicles (Type Approval) (Amendment) Regulations 1989 and shall come into force on 1st October 1989.

2.—(1) Part 1 of Schedule 2 to the Motor Vehicles (Type Approval) Regulations 1980(3) is hereby amended as follows.

(2) In column 2—

(a)in item 20, there is added—

or 76/756/EEC as amended by 80/233/EEC, 82/244/EEC, 83/276/EEC, 84/8/EEC as corrected in O.J. L135, 22.5.1984, p. 27 and 89/278/EEC as corrected in O.J. L114, 27.4.89, p.5228 March 1989O.J. L109, 20.4.89, P.38;

(b) in item 23, there is added—

or 76/759/EEC as amended by 89/277/EEC as corrected by corrigenda published in O.J. L114, 27.4.89, p.5228 March 1989O.J. L109, 20.4.89, p.25.

(3) After item 40, there is added the following new item—

4189/297/EEC 13 April 1989O.J. Ll24, 5.5.89, p.1Lateral protection (side guards) of certain motor vehicles and their trailers.

Explanatory Note

(This note is not part of the Regulations)

1.   These Regulations further amend the Motor Vehicles (Type Approval) Regulations 1980 so that

(a)the type approval requirements relating to the installation of lighting and light signalling devices on motor vehicles and their trailers are, as an alternative to the existing requirements, the requirements of Council Directive 76/756/EEC as amended by Commission Directives 80/233/EEC and 82/244/EEC, Council Directive 83/276/EEC, and Commission Directives 84/8/EEC as corrected and 89/278/EEC, as corrected;

(b)the type approval requirements, relating to direction indicator lamps for motor vehicles and their trailers are, as an alternative to the existing requirements, the requirements of Council Directive 76/759/EEC as amended by Commission Directive 89/277/EEC, as corrected; and

(c)the type approval requirements relating to the lateral protection (side guards) of certain motor vehicles and their trailers are the requirements of Council Directive 89/297/EEC.

2.   Copies of the Council Directives and Commission Directives referred to in these Regulations may be obtained from Her Majesty’s Stationery Office.
