The Annual Close Time (River Dee (Aberdeenshire) Salmon Fishery District) Order 1989

The Secretary of State, on application to him by the River Dee (Aberdeenshire) District Salmon Fishery Board, having carried out all necessary consultations and complied with all necessary procedures as required by paragraphs 3, 4 and 5 of Schedule 1 to the Salmon Act 1986( (1)) as applied by section 6(6) of that Act (there being no objections or representations duly made with respect to the proposals in the application), in exercise of the powers conferred on him by section 6(3) of that Act and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Annual Close Time (River Dee (Aberdeenshire) Salmon Fishery District) Order 1989 and shall come into force on 27th August 1989.

Period within the annual close time for salmon fishing by rod and line

2.  For the part of the River Dee (Aberdeenshire) salmon fishery district specified in the Schedule to this Order, the period within the annual close time (the dates of which are, by virtue of the provisions referred to in section 6(2)(b) of the Salmon Act 1986, 27th August to 10th February) when it is permitted to fish for and take salmon by rod and line is prescribed as the period from 27th August to 31st October, both dates inclusive.

Article 2

SCHEDULE

The part of the River Dee (Aberdeenshire) salmon fishery district mentioned in article 2 of this Order comprises the River Carron and the River Cowie, other than from its source to the downstream side of the Swanley Road Bridge (O.S. Grid Reference No. 807 883), and the area of the sea in Stonehaven Bay landward of, and bounded by, the following lines, that is to say a line drawn from the north east corner of the north breakwater of Stonehaven Harbour (O.S. Grid Reference No. 87930 85496), to Bellman’s Head (O.S. Grid Reference No. 88037 85545), thence a line drawn to the most projecting point of rocks (O.S. Grid Reference No. 88004 86058), between the estuaries of the River Carron and the River Cowie, and thence a line drawn to the Burgh Boundary stone (O.S. Grid Reference No. 87731 86523); all as the said lines are shown on the plan annexed to this Order.

Explanatory Note

(This note is not part of the Order)

In relation to the annual close time of the River Dee (Aberdeenshire) salmon fishery district (27th August to 10th February) this Order prescribes the period from 27th August to 31st October as the period during which fishing for salmon by rod and line is permitted in that part of the district comprising the River Carron, the River Cowie (other than the part from the river’s source to the downstream side of the Swanley Road Bridge) and part of Stonehaven Bay. For the remaining part of the district the period during which such rod and line fishing is permitted in the annual close time continues to be from 27th August to 30th September, by virtue of the provisions referred to in section 6(2)(b) of the Salmon Act 1986.
