The Secretary of State for Education and Science, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on the Secretary of State by section 146(2)(a) of the Education Reform Act 1988(1), hereby make the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Education (Adult Education Centres Funding Schemes) Regulations 1989 and shall come into force on 1st September 1989.

Interpretation

2.  In these Regulations, unless the context otherwise requires–

“the Act” means the Education Reform Act 1988;

“adult education centre” means an institution which provides part-time, but does not provide full-time, further education; and

“further education” has the meaning assigned to it by section 41 of the Education Act 1944(2).

Application of schemes to adult education centres

3.  Local education authorities are hereby authorised to cover adult education centres which meet the requirements set out in regulation 4 in their schemes for financing locally funded further and higher education prepared under section 139 of the Act.

4.  The requirements referred to in regulation 3 are that the adult education centre–

(a) is maintained or assisted by the local education authority;

(b) is treated by the local education authority as being a separate institution for the purposes of financing (irrespective of whether it occupies premises solely for its own use); and

(c) has its own principal or administrative head.

Explanatory Note

(This note is not part of the Regulations)

These Regulations permit local education authorities to bring adult education centres maintained or assisted by them within the scope of their further and higher education funding schemes so long as they are treated by the local education authority as separate institutions for the purposes of financing (whether or not they occupy premises of their own) and have their own principal or administrative head.
