The Prevention of Terrorism (Temporary Provisions) Act 1989 (Commencement No. 1) Order 1989

In exercise of the powers conferred upon me by section 27(3) of the Prevention of Terrorism (Temporary Provisions) Act 19891, I hereby make the following Order:

This Order may be cited as the Prevention of Terrorism (Temporary Provisions) Act 1989 (Commencement No. 1) Order 1989.

In this Order“the 1989 Act” means the Prevention of Terrorism (Temporary Provisions) Act 1989.

This Order extends to the whole of the United Kingdom except that–
a
in so far as this Order brings into force paragraphs 8 and 9 of Schedule 4 to the 1989 Act, this Order extends only to England and Wales;
b
in so far as this Order brings into force paragraphs 18 and 19 of Schedule 4 to the 1989 Act, this Order extends only to Scotland; and
c
in so far as this Order brings into force paragraphs 28 and 29 of Schedule 4 to the 1989 Act, this Order extends only to Northern Ireland.

Schedule 3 to the 1989 Act shall come into force on 1st September 1989 for the purposes of its application in the case of a person–
a
detained under section 14 of, or paragraph 7 of Schedule 2 or paragraph 6 of Schedule 5 to, the 1989 Act, or
b
given a notice under paragraph 2(4) of Schedule 5 to that Act but not detained under paragraph 6 of that Schedule,
where the detention begins or the notice is given at any time after 31st August 1989.

Paragraphs 8, 9, 18, 19, 28 and 29 of Schedule 4 to the 1989 Act shall come into force on 1st September 1989.
