PREVENTION AND SUPPRESSION OF TERRORISM

The Prevention of Terrorism (Temporary Provisions) Act 1989 (Commencement No. 1) Order 1989

In exercise of the powers conferred upon me by section 27(3) of the Prevention of Terrorism (Temporary Provisions) Act 1989(1), I hereby make the following Order:

1.—(1) This Order may be cited as the Prevention of Terrorism (Temporary Provisions) Act 1989 (Commencement No. 1) Order 1989.

(2) In this Order“the 1989 Act” means the Prevention of Terrorism (Temporary Provisions) Act 1989.

(3) This Order extends to the whole of the United Kingdom except that–

(a)in so far as this Order brings into force paragraphs 8 and 9 of Schedule 4 to the 1989 Act, this Order extends only to England and Wales;

(b)in so far as this Order brings into force paragraphs 18 and 19 of Schedule 4 to the 1989 Act, this Order extends only to Scotland; and

(c)in so far as this Order brings into force paragraphs 28 and 29 of Schedule 4 to the 1989 Act, this Order extends only to Northern Ireland.

2.  Schedule 3 to the 1989 Act shall come into force on 1st September 1989 for the purposes of its application in the case of a person–

(a)detained under section 14 of, or paragraph 7 of Schedule 2 or paragraph 6 of Schedule 5 to, the 1989 Act, or

(b)given a notice under paragraph 2(4) of Schedule 5 to that Act but not detained under paragraph 6 of that Schedule,

where the detention begins or the notice is given at any time after 31st August 1989.

3.  Paragraphs 8, 9, 18, 19, 28 and 29 of Schedule 4 to the 1989 Act shall come into force on 1st September 1989.

Explanatory Note

(This note is not part of the Order)

Schedule 3 to the Prevention of Terrorism (Temporary Provisions) Act 1989 provides for the supervision of the exercise of powers of detention and examination under the Act. (These powers came into force on 22nd March 1989, by virtue of section 27 of the Act.) This Order brings the Schedule into force on 1st September 1989 in relation to cases of detention or further examination arising on or after that date.

The Order also brings into force on that date paragraphs 8, 9, 18, 19, 28 and 29 of Schedule 4 to the Act which make provision in the different parts of the United Kingdom for the enforcement of restraint and forfeiture orders made elsewhere in the United Kingdom under paragraph 3 of Schedule 1 to, and section 13 of, the 1989 Act (which also came into force on 22nd March 1989) or in the Channel Islands or Isle of Man under those provisions as extended or under comparable local provision. (No Order has yet been made extending these provisions to the Islands.)
