The Secretary of State for the Environment as respects England, the Secretary of State for Wales as respects Wales and the Secretary of State for Scotland as respects Scotland, in exercise of powers conferred on them by sections 4(2) and 5 of the Reservoirs Act 19751, hereby make the following Regulations:

Citation, commencement and interpretation1

These Regulations may be cited as the Reservoirs (Panels of Civil Engineers) (Reappointment) Regulations 1989, and shall come into force on 15th July 1989.

In these Regulations, “an existing panel” means any of the four existing panels established as a result of a determination of the Secretary of State under section 4(1) of the Reservoir Act 1975, namely, –

a

the Supervising Engineers Panel;

b

the All Reservoirs Panel;

c

the Non-Impounding Reservoirs Panel; and

d

the Service Reservoirs Panel.

Applications for reappointment2

An application by a civil engineer to be reappointed under section 4(2) of the Reservoirs Act 1975 to an existing panel shall be made to the Secretary of State for the Environment in writing, together with:–

a

the information set out in the Schedule to these Regulations; and

b

the prescribed fee.

The prescribed fee is:–

a

in the case of the Supervising Engineers Panel, £115;

b

in any other case, £150.

SCHEDULE

1

The applicant’s full name, address and date of birth.

2

The panel to which the applicant is currently appointed, and the date of his appointment.

3

Relevant qualifications of the applicant.

4

The applicant’s membership of professional institutions.

5

Particulars of the applicant’s present employment.

Particulars of work carried out by the applicant in relation to reservoirs since the date of his current appointment to the panel, including details of the reservoirs in connection with whose design, construction, maintenance or repair the applicant has been employed, and the type, capacity and main dimensions of those reservoirs.

(This note is not part of the Regulations)

These regulations prescribe the manner in which a civil engineer may apply to be reappointed to an existing panel of civil engineers set up for the purposes of the Reservoirs Act 1975.

Section 4(3) of the Act provides that any appointment to such a panel shall be for a term of five years; but an engineer whose appointment expires may be reappointed for a further term.

Provision is made for initial applications to be appointed to an existing panel by:–

The Reservoirs Act 1975 (Supervising Engineers Panel) (Applications and Fees) Regulations 1984 (S.I.1984/1874);

The Reservoirs Act 1975 (All Reservoirs Panel) (Applications and Fees) Regulations 1985 (S.I.1985/175); and

The Reservoirs Act 1975 (Non-Impounding and Service Reservoirs Panels) (Applications and Fees) Regulations 1985 (S.I.1985/1086).
