The Secretary of State, in exercise of his powers under section 19 of the Local Government Act 1974(1) and section 114 of the General Rate Act 1967(2), and of all other powers enabling him in that behalf, after consultation with the associations of local authorities and of persons carrying on undertakings appearing to him to be concerned, and the local authorities and persons carrying on undertakings with whom consultation appears to him to be desirable, hereby makes the following Order:—
1. This Order may be cited as the Docks and Harbours (Rateable Values)(Amendment) Order 1988 and shall come into force on the day after the day on which it is approved by resolution of each House of Parliament.
2. In relation to any year beginning on or after 1st April 1988, the Docks and Harbours (Rateable Values) Order 1976(3) is amended as follows:—
(a)in article 2(2), in the definition of “the Index”, for the word “index” there is substituted the words “General Index”; and
(b)in article 4(2)(b), “35.6147” is substituted for “140.5” as the numerator in the formula.

The rateable values of hereditaments comprising dock or harbour undertakings occupied by statutory undertakers are, by virtue of the Docks and Harbours (Rateable Values) Order 1976, (“the principal order”) calculated by a formula applied to the undertaking’s revenue receipts, adjusted for each year beginning on 1st April by reference to the retail price index in September of the preceding year. The index was re-referenced in January 1987. This order amends the principal order to substitute, in relation to the year 1988—9 and subsequent years, a formula which reproduces the effect of the previous formula by reference to the re-referenced index.
