The Public Utility Transfers and Water Charges Act 1988 (Commencement No. 1) Order 1988

The Secretary of State, in exercise of his powers under section 8(2) of the Public Utility Transfers and Water Charges Act 19881 (hereinafter referred to as “the Act”), hereby makes the following Order:

This Order may be cited as the Public Utility Transfers and Water Charges Act 1988 (Commencement No. 1) Order 1988.

The provisions of the Act specified in Part I of the Schedule to this Order shall come into force on 18th May 1988.

The provisions of the Act specified in Part II of that Schedule shall come into force on 11th July 1988.

PART IIprovisions coming into force on 11th july 1988

Provision of the Act	Subject Matter of Provision
Section 5(1) so far as it gives effect to the following provisions of Schedule 1, namely paragraphs 2(1) to (8), 3 to 5, 6 (so far as it relates to paragraphs 2(1) to (8) and 3) and 9(b) and (so far as relevant to paragraph 6) (c), (e) and (f).	Provisions relating to meters: power to carry out works and enter premises; entry in execution of a warrant; offence of disclosing information by person exercising powers; obstruction of person exercising power; expenses connected with meter installation, and undertakers' liability for damage; and arbitration.
Section 6(1) so far as it gives effect to paragraph 3 of Schedule 2.	Consequential amendment.
Section 6(5) so far as it gives effect to the entries in Schedule 3 repealing section 82(1)(a) of Schedule 3 to the Water Act 19453 and section 32 of the Water Act 1973.	Repeals.
Section 6(2) to (4) and (6).	Orders to amend local legislation relating to metering, and effect of repeal of provisions incorporated with such legislation.

This Order brings into force on 18th May 1988 the following provisions of the Public Utility Transfers and Water Charges Act 1988, together with related amendments and repeals—

section 2, which confers a general charging power on statutory water companies;
section 3(1) to (5) and (8), which regulates the charges of water authorities and statutory water companies;
section 4, which concerns metering trials schemes; and section 5(2) to (5), which enables the Secretary of State to make regulations about metering.

This Order also brings into force on 11th July 1988 the following provisions of the 1988 Act, together with related amendments and repeals—

section 5(1), to the extent that it gives effect to the following provisions of Schedule 1—
- paragraph 2(1) to (8), which provides for powers to carry out works connected with metering and for powers of entry,
- paragraphs 3 to 5, which concern entry in execution of a warrant, offence of disclosing information by person exercising powers of entry, and obstruction of person exercising such powers,
- paragraph 6 (partially), which provides for expenses connected with meter installation and undertakers' liability for damage, and
- paragraph 9 (partially), which provides for arbitration; and
section 6(2) to (4) and (6), which concerns the Secretary of State’s power to make orders amending local legislation relating to metering, and the effect of repeals of provisions incorporated with local legislation.
