The Salmon and Freshwater Fisheries (Expenses) Regulations 1988

The Minister of Agriculture, Fisheries and Food and the Secretary of State for Wales, in exercise of the powers conferred by section 28(3), (5) and (6) of, and paragraph 12 of Schedule 3 to, the Salmon and Freshwater Fisheries Act 1975(1), and now vested in them(2) and of all other powers enabling them in that behalf, hereby make the following Regulations:—
Title, commencement and interpretation1

These Regulations may be cited as the Salmon and Freshwater Fisheries (Expenses) Regulations 1988 and shall come into force on 27th April 1988.

In these Regulations—
“the Act” means the Salmon and Freshwater Fisheries Act 1975;
“the Minister” means, in relation to those areas in which the water authorities other than the Welsh Water Authority exercise their functions, the Minister of Agriculture, Fisheries and Food, and in relation to the area in which the Welsh Water Authority exercise their functions, the Secretary of State for Wales.
Payment of expenses of inquiries etc2
The expenses of and incidental to any public local inquiry held under Part I of Schedule 3 to the Act, and to any other matter of procedure respecting the making of any order under that Part of that Schedule, shall be paid by the applicant for the order or by any other party to the proceedings in such manner and in such proportion as the Minister may direct.
Revocation3
The Salmon and Freshwater Fisheries Regulations 1924(3) are hereby revoked.
