The Advice and Assistance (Scotland) Amendment Regulations 1988

The Secretary of State, in exercise of the powers conferred upon him by sections 12(3), 37(1) and 42 of the Legal Aid (Scotland) Act 1986(1) and of all other powers enabling him in that behalf, and with the concurrence of the Treasury, hereby makes the following Regulations:

These Regulations may be cited as the Advice and Assistance (Scotland) Amendment Regulations 1988 and shall come into force on 11th April 1988.

In these Regulations, “the principal Regulations” means the Advice and Assistance (Scotland) Regulations 1987(5).

Regulation 15(1)(a)(v) of the principal Regulations shall be amended by inserting, after the words “by way of”, the words “income support or family credit under the Social Security Act 1986(2)”,

After regulation 15(1)(a)(vi) of the principal Regulations, there shall be inserted the following:—
vii
by way of any payment made out of the social fund under the Social Security Act 1986;

Paragraph 4 of Schedule 2 to the principal Regulations shall be amended by substituting, for the words “section 17 of the Supplementary Benefits Act 1976(3)”

For paragraph 8(b)(ii) of Schedule 2 to the principal Regulations, there shall be substituted the following:—
ii
in the case of a dependent child or a dependent relative, at a rate equivalent to 25 per cent above the amount specified for the time being in paragraph 2 of Part 1 of Schedule 2 to the Income Support (General) Regulations 1987(4) appropriate to the age of the child or relative.
