The Secretary of State, after consulting with the organisations referred to in section 99(2) of the Merchant Shipping Act 19701, in exercise of powers conferred by section 17 of that Act and now vested in him2, and of all other powers enabling him in that behalf, hereby makes the following Regulations:—

These Regulations may be cited as the Merchant Shipping (Maintenance of Seamen’s Dependants) (Amendment) Regulations 1988 and shall come into force on 11th April 1988.

The Merchant Shipping (Maintenance of Seamen’s Dependants) Regulations 19723 shall be amended by replacing in regulation 4(a) the reference to “the Ministry of Social Security Act 1966”4 by a reference to “the Social Security Act 1986”5.

These Regulations amend the Merchant Shipping (Maintenance of Seamen’s Dependants) Regulations 1972 by substituting for the reference to the Ministry of Social Security Act 1966 a reference to the Social Security Act 1986. The 1972 Regulations enable certain “responsible authorities” to serve notice on employers to retain out of seamen’s wages expenses those authorities have incurred in respect of his dependants. Those expenses include payment of certain Social Security benefits.
