Coming into force
The Secretary of State, in exercise of the powers conferred on him by section 11 of the Consumer Protection Act 19871 hereby makes the following regulations:—

These Regulations may be cited as the Three-Wheeled All-Terrain Motor Vehicles (Safety) Regulations 1988.

These Regulations shall come into force on 7th December 1988 and shall cease to have effect at the expiration of a period of twelve months beginning with that date.

It appears to the Secretary of State that the need to protect the public requires that these Regulations should be made without delay.

Subject to regulation 4 below, no person shall supply, offer to supply, agree to supply, expose for supply or possess for supply any vehicle with three wheels which is propelled by an internal combustion engine and is designed or constructed primarily for use in leisure activities (including competitive racing) on either
a
all types of land surface; or
b
all types of land surface other than any highway or any other road, or bridge over which a road passes, to which the public has access,
and not primarily for agricultural or forestry purposes.

Regulation 3 does not apply to:—
a
a vehicle which is specially designed, constructed or adapted for the use of a person suffering from some physical defect or disability; or
b
a two-wheeled motor cycle with a side-car attached thereto.
