Coming into force

The Minister of Agriculture, Fisheries and Food and the Secretaries of State respectively concerned with the sea fishing industry in Scotland, Wales and Northern Ireland, acting jointly, in exercise of the powers conferred on them by sections 5(1), (5), 15(3) and 20(1) of the Sea Fish (Conservation) Act 19671, and of all other powers enabling them in that behalf, hereby make the following Order:

Title and commencement1

This Order may be cited as the Cod (Specified Sea Areas) (Prohibition of Fishing) (Variation) Order 1988 and shall come into force on 17th October 1988.

Variation2

The Cod (Specified Sea Areas) (Prohibition of Fishing) Order 19882 is hereby varied by inserting in article 2 thereof (prohibition), after the words “is prohibited” the words “except on and between 17 October and 31 October 1988”.

This Order varies the Cod (Specified Sea Areas) (Prohibition of Fishing) Order 1988 “the principal Order”, which prohibits fishing for cod (Gadus morhua

a

by any British fishing boat registered in the United Kingdom or the Isle of Man within any part of a sea area specified in the Schedule to that Order, or

b

by any British fishing boat registered in any of the Channel Islands or by any British-owned fishing boat within any part of such a sea area which lies inside British fishery limits.

This Order varies article 2 of the principal Order to provide that the above-mentioned prohibition shall not apply on and between 17th October and 31st October 1988.

The principal Order ceases to have effect on 31st December 1988.
