The Environmentally Sensitive Areas (The Broads) Designation (Amendment) Order 1988

Coming into force
Whereas, pursuant to section 18(1) of the Agriculture Act 1986(1), the Minister of Agriculture, Fisheries and Food has by order designated an area in the Broads as an environmentally sensitive area(b);

And whereas, pursuant to section 18(4) of the said Act, the said Minister has specified in the order designating the above-mentioned area the requirements as to agricultural practices, methods and operations and the installation or use of equipment which must be included in agreements made under section 18(3) of the said Act as respects agricultural land in that area;

Now, therefore, the said Minister, in exercise of the powers conferred on him by section 18(1), (4) and (11) of the said Act, and of all other powers enabling him in that behalf, with the consent of the Treasury, hereby makes the following Order:—

Citation, and commencement

1.

This Order may be cited as the Environmentally Sensitive Areas (The Broads) Designation (Amendment) Order 1988 and shall come into force on 1st March 1988.Amendment of principal Order

2.

The Environmentally Sensitive Areas (The Broads) Designation Order 19862 shall be amended in accordance with articles 3 and 4 below.

In article 2(1) (interpretation) there shall be inserted immediately after the definition of “agreement” the following definition:

““cow” means a female bovine animal which has calved at least twice;”.

In article 2 (interpretation) there shall be substituted for the definition of “livestock unit” the following definition:

  • ““livestock unit” means—

    1. (a)

      1 cow, or

    2. (b)

      1.4 bovine animals (other than cows) more than two years old, or

    3. (c)

      1.6 bovine animals (other than cows) from one year old to two years old inclusive, or

    4. (d)

      2.5 bovine animals less than one year old, or

    5. (e)

      1 equine animal more than six months old, or

    6. (f)

      6.66 sheep;”

This Order amends an Order previously made by the Minister of Agriculture, Fisheries and Food which designated an area in the Broads as an environmentally sensitive area. The Order inserts a definition of “cow” and, for clarification, substitutes a new definition of “livestock unit” (articles 3 and 4).
